ગુજરાત સરકારે કોઇપણ જાતના ટેન્‍ડરની પ્રક્રિયા કે સ્‍પર્ધાત્‍મક ભાવો મંગાવ્‍યા વગર ર૦૦ હેકટર જમીન રપ મેગાવોટ પાવર પ્‍લાન્‍ટ માટે લંડનના એક ઉદ્યોગપતિને એટલા માટે આપી દીધી છે કે, તેની ભલામણ મુખ્‍યમંત્રીશ્રીની વિરુધ્‍ધમાં ચાલતાં કેસોમાં નામદાર સુપ્રીમ કોર્ટે નિયુક્ત કરેલા An amicus curaie (કોર્ટને મદદરુપ બનવા નિયુક્ત કરેલા વકીલ) શ્રી હરિશ સાલ્‍વેજીએ ભલામણ કરી હતી. કોઇપણ કેસમાં An amicus curaie નો અભિપ્રાય ઘણોજ મહત્‍વનો હોય છે.

 વિરોધપક્ષના નેતાશ્રી શક્તિસિંહ ગોહિલે ગુજરાતના મુખ્‍યમંત્રીશ્રીએ પોતાની જાતને બચાવવા માટે ગુજરાતને કરોડો રુપિ‍યાનું નુકશાન થાય તેવો ઇરોસ કંપની સાથે સોદો કર્યો છે. જેને તાત્‍કાલિક રદ કરવા માંગણી કરી છે.

        જો ખરેખર ટેન્‍ડરની પ્રક્રિયા થઇ હોત તો ર૦૦ હેકટર જેવી જમીન અને બીજા અનેક લાભો કે જે ઇરોસ કંપનીને આપવામાં આવ્‍યા છે તે અન્‍ય કોઇ કંપનીને આપવામાં આવે તો પંદર રુપિ‍યા યુનિટના બદલે ઘણી સસ્‍તી સોલાર એનર્જીથી વિજળી ગુજરાતને મળી શકે. ઇરોસ કંપની પાસેથી પંદર રુપિ‍યા જેવા મોંઘા ભાવથી વિજળી ખરીદવાના પૈસા દેવા માટે આમ ગુજરાતી ઉપર વીસ પૈસાનો વધારાનો વિજ ડયૂટીનો બોજો આ બજેટમાં નાંખવામાં આવેલ છે. ગુજરાતના મુખ્‍યમંત્રીશ્રી પોતે સીધા તહોમતદાર બને તેવા કેસો નામદાર સુપ્રિમ કોર્ટ પસે ચાલી રહ્યાં છે તેમાંથી બચવા માટે નામદાર સુપ્રિમ કોર્ટ દ્વારા નિયુકત An amicus curaieને ઓબ્‍લાઇઝ કરવા માટે આ ભ્રષ્‍ટ સોદો થયેલો છે. શ્રી હરિશ સાલ્‍વેજીએ ગુજરાતના મુખ્‍યમંત્રીશ્રીના સામેના કેસોમાં જયારે તટસ્‍થ વ્‍યકિત તરીકે નિયુકત થયા હોય ત્‍યારે તેઓએ કોઇપણ પ્રકારનું કોમ્‍યુનિકેશન કરવું જ ન જોઇએ. શ્રી હરેશ સાલ્‍વેજીની ગુજરાતના એડિશનલ એડવોકેટ જનરલ સાથેની તથા ગુજરાતના એડિશનલ એડવોકેટ જનરલની મુખ્‍યમંત્રીશ્રીના કાર્યાલય સાથે થયેલાં ઇમેઇલનો સપૂર્ણ સંદેશા વ્‍યવહાર સમગ્ર પ્રકરણનો પર્દાફાશ કરે છે. શ્રી ગોહિલે શ્રી હરીશ સાલ્‍વે, ગુજરાતના એડિશનલ એડવોકેટ જનરલ તથા મુખ્‍યમંત્રીશ્રીના કાર્યાલયના ઇમેઇલ સંદેશા વ્‍યવહારની અક્ષરસહ કોપી પ્રેસ અને મિડિયાને રજૂ કરી છે.

કોઇપણ કેસમાં નિમાયેલાં An amicus curaie (કોર્ટને મદદરુપ બનવા નિયુકત વકિલ) સંપૂર્ણ તટસ્‍થ અને પક્ષપાત કે ભયથી મુક્ત બની સત્‍ય હકીકત કોર્ટ પસે પહોંચાડવા માટેની મોટી જવાબદારી વહન કરતાં હોય છે. કોર્ટ દ્વારા નિયુકત An amicus curaie ખૂબજ મહત્‍વનો ભાગ ભજવતા હોય છે. ગુજરાતના મુખ્‍યમંત્રીશ્રી સામેના એક કરતાં વધારે કેસ કે જેમાં ગુજરાતના મુખ્‍યમંત્રીશ્રીને તહોમતદાર બનાવવાની માંગણી છે તે કેસોમાં શ્રી હરિશ સાલ્‍વે An amicus curaie તરીકે નિયુકત થયે.લાં છે. શ્રી સાલ્‍વેજીની જવાબદારી નામદાર સુપ્રિમ કોર્ટને કેસની સત્‍ય હકીકતો પહોંચાડવા મદદરુપ બનવાની તેમજ ન્‍યાયના હિતમાં તટસ્‍થ રીતે કોર્ટના મિત્ર બનવાની હોય છે તેના બદલે જે રીતની હકીકતો બહાર આવી છે. તેના પરથી સાબિત થાય છેકે, શ્રી સાલ્‍વેજી કોર્ટના નહીં પરંતુ તચહોમતદારના સાથે જોડાઇને ઇરોસ કંપનીને મદદરુપ બની રહ્યાં છે.

ઇમેઇલના વ્‍યવહાર સ્‍પષ્‍ટ દર્શાવે છે કે ઇરોસ કંપનીને મદદરુપ બનવા શ્રી હરિશ સાલ્‍વે દ્વારા ભાગ બજવાયો છે. કોઇપણ ટેન્‍ડરની પ્રક્રિયામાં મુખ્‍યમંત્રીશ્રીએ હસ્‍તક્ષેપ કરવાનો હોતોનથી. વિભાગ દ્વારા પારદર્શક રીતે કામ થવું જોઇએ. ઇરોસ કંપની ઉર્જા વિભાગમાં અરજી કરી ચૂકી હતી અને વિભાગ ગુણાવત્‍તાના ધોરણે નિર્ણય  તેની તરફેણમાં લેવો કે નહી તે નિર્ણય કરે તેવી જોગવાઇ છે. આમ છતાં શ્રી હરિશ સાલ્‍વે સીધા મુખ્‍યમંત્રીશ્રીને કોઇપણ સંદેશાવ્‍યવહાર કરે તો તેનો અર્થ એ થાય કે શ્રી સાલ્‍વેને રાજી રાખવા માટે ઇરોસ એનર્જી ગૃપને તેને માંગ્‍યા મુજબ કરોડો રુપિ‍યાનો ફાયદો કરી દેવો. આ ભ્રષ્‍ટ સોદામાં મુખ્‍યમંત્રીશ્રીના કાર્યાલયમાં શ્રી પ્રિન્‍સીપલ સેક્રેટરીશ્રી કે.કૈલાશનાથન, એડિશનલ પ્રીન્‍સીપાલ સેક્રેટરીશ્રી ગીરીશચંદ્ર મુર્મુ તથા મુખ્‍યમંત્રીશ્રીની ઓફિસના ઓફિસર ઓન સ્‍પેશ્‍યલ ડયુટી શ્રી ભાવસાર કેવી રીતે સંકળાયા તેની હકીકત પકડાયેલા ઇમેઇલ પરથી મળી શકે છે. ઇરોસ એનર્જીના અધિકારી આજ પ્રોજેકટો માટે અગાઉ ઉર્જા વિભાગમાં શ્રી ડી.જે.પાંડીયન તથા અન્‍યોને મળ્યાં હતાં. જો ગુણાવત્‍તાના ધોરણો ઇરોજ એનર્જીના પ્રોજેકટ મળે તેમ હોત તો તેઓને આ પ્રોજેકટ ઉદ્યોગ વિભાગમાંથી મળી ગયો હોત. ગુણાવત્‍તાના ધોરણોને નેવે મૂકીને કરોડોનું કૌભાંડ કરવા શ્રી સાલ્‍વેનો ઉપયોગ થયો  છે.

Best Regards. Daniel.” The mail was copied to Kishore Lulla and Eros Energy Group CEO Sean Hanafin.On 28 April, Harish Salve forwarded Lulla’s project report and his letter to Modi to the Gujarat government’s Additional Advocate General Tushar Mehta on his email id tusharmehta99@yahoo.co.in <mailto:tusharmehta99@yahoo.co.in> . He wrote: “Dear Tushar. Attached is a note on the solar project. Best wishes.” (THIS MEANS this issue was discussed between TuSHAR Mehta and Harish Salve because it does not give any background and directly the letter and project report::: an observation by Shaktisinh Gohil)

                   On 29 April, Mehta forwarded Salve’s email along with Lulla’s project report and letter to Girishchandra Murmu, the additional principal secretary to the chief minister, on his email id gcm1@rediffmail.com <mailto:gcm1@rediffmail.com> . He wrote: “Dear Shri Murmu. Please find enclosed herewith a letter sent to me by Shri Harish Salve along with the project report of Eros Energy. Regards. Tushar Mehta.” Mehta wrote this mail at 10.02 pm.Within four minutes, at 10.06 pm, Mehta emailed back to Salve: “Dear Shri Salve. As discussed, please find the mobile phone numbers of the following: 1. Shri K Kailashnathan, IAS, principal secretary to the chief minister, 9978406003. 2. Shri Girish Chandra Murmu, IAS, additional principal secretary to the chief minister, 9978406119. With Regards. Tushar Mehta.”Further to this email correspondence, on 4 May 2010, Mehta forwarded Salve’s email along with Lulla’s project report and letter to Sanjay Bhavsar, officer on special duty to the CM, on Bhavsar’s email id osd2cm@gmail.com <mailto:osd2cm@gmail.com> . He wrote: “Dear Shri Sanjaybhai. Kindly find herewith the mail received from Shri Harish Salve. Please do the needful.”The same day, bhavsar wrote back to Mehta: “Dear Sir. Received your mail. I will reply you shortly (sic). Thanks.”

શ્રી ગોહિલે ઇરોસ એનર્જી સાથે થયેલાં સોદાને તાત્‍કાલિક રદ કરવા અને શ્રી હરિશ સાલ્‍વેને નામદાર સુપ્રિમ કોર્ટમાંથી An amicus curaie તરીકે રાજીનામું આપી દેવા માંગણી કરી છે.

           Gujarat Government without inviting tender or bid has given away 200 hectares of land and a 25 MW solar power plant project to a London based industrialist who has been recommended by Harish Salve. This has been done by Narendra Modi because he is embroiled as accused in supreme court case where Salve is amicus curaie and his opinion can matter.

             Congress Legislative Party leader Shaktisinh Gohil has said that London based Eros Energy has been given this project after it was recommended by Harish Salve, senior supreme court advocate.Mr Gohil has said this is clearly a DEAL struck by Gujarat government because Harish Salve is the amicus curaie in cases directly involving Chief Minister Narendra Modi. An amicus curaie’s opinion is very important and Mr Gohil has said that this deal has been struck to influence and oblige the Amicus because Mr Modi is guilty and is scared of Supreme court. Harish Salve is the same person who is right now also fighting Ratan Tata’s case that his conversations with Nira Radia should not be made public. This man who is defending Nira Radia and Ratan Tata is now being favoured by the Narendra Modi government.

             Mr Gohil said that an amicus curaie is the Friend of the Court. He is supposed to be balanced, unbiased and completely objective. Harish Salve was appointed amicus curaie in case which has Narendra Modi as an accused. An amicus curaie is supposed to be very important link and so Harish Salve  has been obliged to save Mr Narendra Modi.However Mr Gohil has said that instead of being supreme court’s friend and trying for justice in public interest, he has become a “friend” of Narendra Modi government.Shaktisinh Gohil has demanded that the power plant deal be scrapped in public interest and in interest of justice. Also Harish Salve should resign from this case.

             Mr Gohil has disclosed details of the murky business in which Chief Minister’s office and Modi’s close men including his principal secretary K Kailasnathan and his additional principal secretary home Girishchandra Murmu are directly involved.Giving details of the sensational scam, Mr Shaktisin Gohil said.Harish Salve first discussed a project and then wrote to Tushar Mehta, Gujarat’s additional advocate general giving him entire details of the power plant project. Tushar Mehta forwarded the mails to Chief Minister Narendra Modi’s office. He also gave personal numbers of Kailasnathan and Murmu to Harish Salve. Harish Salve wrote to them and chief minister’s officer on special duty Sanjay Bhavsar. Every where that Tushar Mehta wrote, he mentioned that this is the project that Harish Salve has recommended.It must be noted that before Harish Salve’s recommendation, the Eros Energy officials had already met energy department’s D J Pandian and others but were not getting favourable response. However, after Harish Salve got into the picture, the power plant was cleared .This is a clear deal.

             Mr Gohil has said that Eors Energy has been given this project just because Gujarat government viewed it as Harish Salves’s project and Harish Salve had to be obliged because he is amicus curaie. Mr Gohil said that in public interest the Eros energy deal should be scrapped and Harish Salve should resign.

વાયબ્રન્‍ટ ગુજરાતના ખૂબજ મોટા ધિરાણો આવી જાય છે તેવી સદંતર જુઠ્ઠાણાભરી વાતો કરનાર ગુજરાતની સરકારનો આજે વિધાનસભામાં પ્રશ્નોતરીના લેખિત જવાબમાં પર્દાફાશ થયો હતો. વિધાનસભામાં પ્રશ્ન ક્રમાંક-રપ ઉપ્‍ર કોંગ્રેસના ધારાસભ્‍યશ્રી ખુમાનસિંહ ચૌહાણના પ્રશ્નના જવાબમાં રાજય સરકારે સ્‍વીકારવું પડ્યું હતું કે, વાય્બ્રન્‍ટ ગુજરાત સમિટ ર૦૦૭ અને ર૦૦૯માં પ્રવાસન ક્ષેત્રે પર.ર૧૪ કરોડ રુપિ‍યાના ધિરાણો આવશે તેવી જાહેરાત કરવામાં આવી હતી. પરંતુ તા.૩૧.૧ર.ર૦૧૦ની સ્થિતિ સુધીમાં એટલે કે લાંબા સમય પછી પણ ખરેખર પ્રવાસન ક્ષેત્રમાં મૂડીરોકાણ માત્ર ૪૧પ કરોડનું આવેલું છે. વાયબ્રન્‍ટ ગુજરાત જેવા ઉત્‍સવો પાછળ કરોડો રુપિ‍યા ન ખર્ચાયા હોત તો પણ આટલું મૂડીરોકાણ આવ્‍યું હોત. પર,૦૦૦ કરોડ રુપિ‍યાના રોકાણોની જાહેરાત કર્યા પછી માત્ર ૪૧પ કરોડ રુપિ‍યાનું મૂડીરોકાણ આવેલું છે. તેજ બતાવે છે કે, ગુજરાતની ભાજપની સરકાર વાયબ્રન્‍ટ ગુજરાતના નામે કેવા જુઠ્ઠાણા ચલાવે છે.

        આજે વિધાનસભામાં કોંગ્રેસના ધારાસભ્‍યશ્રીના પ્રશ્નના જવાબમાં  એ વાતનો પર્દાફાશ થયો હતો. ગુજરાત સરકાર પ્રસિધ્ધિઓ પાછળ કરોડો રુપિ‍યા ખર્ચે છે પરંતુ મેડિકલ કોલેજના સ્‍ટાફની ભરતી કરતી નથી. ગુજરાતની જુદી જુદી સરકારી મેડિકલ કોલેજોમાં અનેક જગ્‍યાઓ ઘણાં લાંબા સમયથી ખાલી છે. ઉમેદવારો ઉપલબ્‍ધ હોવા છતાં વર્ગ-૩ અને વર્ગ-૪ની જગ્‍યાઓ પર ગુજરાતના યુવાનોને નિમણૂંક આપવાના બદલે આઉટસોર્સિગના નામે ભ્રષ્‍ટાચાર થઇ રહ્યો છે.

        ગુજરાતમાં ખેત તલાવડાઓના અને બોરીબંધના નામે વ્‍ય‍વસ્થિત કૌભાંડ ચાલી રહ્યું છે. છેલ્‍લાં પાંચ વર્ષમાં ગુજરાતમાં એકપણ નાની કે મોટી સિંચાઇ માટેના ડેમ બનાવવામાં આવ્‍યા નથી. ગુજરાતના ખેડૂતોના હિતમાં ભૂતકાળની સરકારોએ મોટા ડેમ બાંધવામાં આવેલા હતાં તેનો ફાયદો આજે પણ ખેડૂતોને છે. જયારે વર્તમાન સરકાર મધ્‍યમ અને મોટા ડેમ બનાવવાના બદલે નાના તલાવડાઓના નામે ભ્રષ્‍ટાચાર કરી રહી છે. તે આજની પ્રશ્નોતરીમાંથી સરકારે આપેલા જવાબો દ્વારા પ્રસ્‍થાપિત થાય છે.

        આજની પ્રશ્નોતરીમાં વિધાનસભામાં  પ્રશ્ન ક્રમાંક- ૭૩ ઉપર કોંગ્રેસના ધારાસભ્‍યશ્રી ફારુકભાઇ શેખના પ્રશ્નના જવાબમાં સરકારે સ્‍વીકાર્યુ  કે, અમદાવાદમાં આવેલી સિવિલ હોસ્‍પીટલમાં ૧૦૯ જેટલી નર્સ બહેનોની જગ્‍યા ખાલી છે. નર્સીંગનો કોર્ષ કરેલ અનેક બહેનો ઉપલબ્‍ધ હોવા છતાં પ્રચાર પાછળ ખર્ચ કરનારી ગુજરાત સરકાર જગ્‍યાઓ ખાલી હોવા છતાં નર્સ બહેનોને નોકરી આપતી નથી.

        ગુજરાતને કેન્‍દ્રમાંથી અન્‍યાય થાય છે તેવી સદંતર જુઠ્ઠી વાતો કરનાર સરકારનો આજે વિધાનસભામાં પ્રશ્ન ક્રમાંક – ૬૮નો જવાબ સ્‍પષ્‍ટ છે કે, જવાહરલાલ નહેરુ અર્બન રિન્‍યુઅલ ‍મીશન નીચે ગુજરાતને કરવેરાના હિસ્‍સા પેટે મળતાં રુપિ‍યા ઉપરાંત શહેરી વિસ્‍તારમાં વિકાસના કામો માટે છેલ્‍લાં ત્રણ વર્ષમાં ૧૬૦૦ કરોડ કરતાં વધારે રુપિ‍યા ફાળવવામાં આવેલા છે.

• One who is known for his violent activities cannot build Mahatma’s temple.
• Gujarat government becomes vibrant for handful of rich people, but it has nothing to offer to ordinary people.
• Money given for tribals under RSVM has been siphoned by NGO run by a BJP leader.
• Law and order situation in the state is out of control.
• In polytechnics and engineering colleges more than 70 per cent posts of teachers and principals are vacant.
• Government is not bothered about students of Amargadh Medical college of Bhavnagar.
• There should be an independent inquiry into the allegations of an IAS against Chief Minister that he is corrupt and his conduct is immoral

 Leader of Opposition in the Assembly Shaktisinh Gohil today lamented that the Governor’s address to the House which is official view of the programmes and policies of the government does not show any concern for common man. Speaking on the Governor’s address in the House, he said that Gujarat government becomes vibrant for handful of rich people, but it has nothing to offer to ordinary people.

 Talking about the much publicized Mahatma Mandir project, he said that billions were spend on it, but it was of no use if the Gandhian thought does not become part of deed and action in real life. When the hands soaked in violence build the temple of Mahatma, it is an insult of the icon of non violence. He said that while Mahatma traveled in third class, Gujarat Chief Minister always travel by air. Mahatma was concerned about poor and deprived while the Chief Minister is always worried about the interests of rich and influential. Mahatma had plain cloth wrapped around him, whereas the Chief Minister changes designer clothes five times a day. Gujarat misappropriates funds for poor. Giving an example of this he said that Rs 15 crore were allotted for Rasthra Sam Vikas Yojna for poor tribal of Panchmahal. However, a study by IRMA exposed that three NGO having close connections with BJP were given Rs 80.46 lakh. Nothing reached the beneficiaries according to the study done as per instructions of the centre.

 This government is doing biggest injustice to tribal people. Central government has made law in favour of tribal but they are not given land rights by the Gujarat government. On the other hand there are moves to give land to moneyed people which made tribal owner a labourer in his own land. Gujarat government changes its colors like chameleons. He said that Governor’s address talks about minorities. However, the fact is that while other states have got good and excellent remarks about the implementation of Prime Minister’s programme, Gujarat has got nothing.

 He said that minorities in Gujarat are prone to attacks maximum in the country. Giving figures, Gohil said that in 2006-07 there were 1244 attacks while in 2007-08 the number increased to 1372 instead of decrease.

 Gujarat government is not discharging its constitutional duties, he said. Human Rights Commission is not given adequate staff. Despite increase in the workload of the RTI commission it is not given more hands. Lokayukta has not been appointed and the post of Deputy Speaker of Assembly is vacant for past several years. All these instances are insult to constitution and democracy.

 Giving an example of worst kind of law and order situation, he said that a journalist of Kathlal was badly beaten up by police when he exposed a bootlegger. But no action has been taken against police. Those involved in the murder of Mulubhai Modhvadia have been honoured by giving license for their firearms. Government has not done any justice to Jabbardan Gadhvi in Kutch nor tried to save his live.

 Standard of education is deteriorating in the state. In polytechnics and engineering colleges more than 70 per cent posts of teachers and principals are vacant. They should be filled immediately. Government is not bothered about students of Amargadh Medical college of Bhavnagar. One year is wasted.

 There should be an independent inquiry into the allegations of an IAS against Chief Minister that he is corrupt and his conduct is immoral. The officer has written to the Chief Secretary for an inquiry. Citing this Gohil said that there should be an inquiry by SIT or CBI team constituted by the Supreme Court.

• રાજ્યપાલશ્રીના પ્રવચનમાં સરકાર તરફથી  કોઇપણ જાતની ગુજરાતના આમ આદમી માટેની દિશા કે દ્રષ્ટિ નથી.
• જેના હાથ હિંસાથી ખરડાયેલા હોય તે અહિંસાના પૂજારીનું મંદિર ન બનાવી શકે.
• મુઠ્ઠીભર મૂડીપતિઓ માટે ગુજરાતની સરકાર વાયબ્રન્‍ટ બને છે પરંતુ આમ આદમીને કોઇ ફાયદો નથી.
• આદિવાસી સમાજ માટે અપાયેલા આર.એસ.વી.એમ.ના પૈસા ભા.જ.પ.ની સાથે જોડાયેલાં એન.જી.ઓ.ખાઇ ગયાં.
• રાજ્યમાં કાયદો અને વ્‍યવસ્‍થા સંપૂર્ણ કથળી ગઇ છે.
• પોલીટેકનીક અને એન્‍જીનીયરીંગમાં પ્રિન્‍સીપાલથી લઇને પ્રાધ્‍યાપક સુધીની ૭૦ ટકા કરતાં પણ વધારે જગ્‍યાઓ ખાલી.
• ભાવનગરની અમરગઢ મેડીકલ કોલેજના વિદ્યાર્થીઓની રાજ્ય સરકાર ચિંતા કરતી નથી.
• ગુજરાતના આઇ.એ.એસ. અધિકારીના મુખ્‍યમંત્રીશ્રી સામેના ભ્રષ્‍ટાચાર અને અનૈતિક વર્તનના આક્ષેપની તટસ્‍થ તપાસ થાય.

ગુજરાત વિધાનસભામાં માનનીય રાજ્યપાલશ્રીનું પ્રવચન એ સરકારે તૈયાર કરી આપેલું સરકારી નીતિ, આયોજન અને આગામી કાર્યક્રમોની પ્રતિતિ કરાવતું હોય છે. ગુજરાતની સરકારે કોઇ દિશા કે દ્રષ્ટિ ગુજરાતના આમ લોકોના કલ્‍યાણ માટેની માનનીય રાજ્યપાલશ્રીના પ્રવચનમાં રજુ કરેલી નથી. માનનીય રાજ્યપાલશ્રીના પ્રવચન ઉપર  બોલતાં વિરોધપક્ષના નેતાશ્રી શક્તિસિંહ ગોહિલે જણાવ્‍યું હતું કે, ગુજરાતની સરકાર મુઠ્ઠીભર મૂડીપતિઓ માટે વાયબ્રન્‍ટ બની જાય છે પરંતુ આમ ગુજરાતીઓની ચિંતા ગુજરાતની સરકાર કરતી નથી. મહાત્‍મા ગાંધીના મંદિર પાછળ કરોડો ખર્ચાયા પછી જો મહાત્‍માજીની વિચારધારાને દિલ અને દિમાગમાં ન ઉતારી શકાય તો એવા ખર્ચાનો કોઇ અર્થ નથી. કહેવાયું છે કે, ”મન ચંગા તો કથરોટમાં ગંગા”. જયારે ‍હિંસાથી ખરડાયેલા હાથ અહિંસાના પૂજારી મંદિર નિર્માણ કરે ત્‍યારે તે અહિંસાના પૂજારીનું અપમાન છે. મહાત્‍મા ગાંધી થર્ડ કલાસના ડબ્‍બામાં મુસાફરી કરતા હતાં જયારે ગુજરાતના મુખ્‍યમંત્રીશ્રી હવાઇ જહાજથી નીચે પગ મૂકતાં નથી. મહાત્‍મા ગાંધીજી ગરીબ અને વંચિતોને માટે હંમેશા ચિંતિત રહેતાં જયારે ગુજરાતના મુખ્‍યમંત્રીશ્રી ધનપતિઓ માટે વાયબ્રન્‍ટ બને છે. મહાત્‍મા ગાંધીજી સાદી પોતડી પહેરતાં હતાં જયારે ગુજરાતના મુખ્‍યમંત્રીશ્રી દિવસમાં પાંચ વખત ડિઝાઇનર કપડાં બદલે છે.

        ગુજરાતના ગરીબો માટેના પૈસા પણ ગુજરાતની સરકાર ખાઇ જાય છે. તેનો દાખલો આપતાં વિરોધપક્ષના નેતાશ્રીએ જણાવ્‍યું હતું કે, રાષ્‍ટ્ર સમ વિકાસ યોજના નીચે પંચમહાલ જિલ્‍લાના ગરીબ આદિવાસીઓ માટે પંદર કરોડ રુપિ‍યા ફાળવેલા હતાં. ગરીબોને આ પૈસા પહોંચાડવાને બદલે ભા.જ.પ.ના મળતીયા ત્રણ એન.જી.ઓ.ને ૮૦ લાખ ૪૬ હજાર રુપિ‍યા ચૂકવી દેવામાં આવ્‍યા હતાં. ઇરમા સંસ્‍થા દ્વારા કેન્‍દની સૂચના મુજબ ચેકીંગ કરવામાં આવ્‍યું ત્‍યારે ખબર પડી કે લાભાર્થી કુટુંબોને કોઇ લાભ મળ્યો નથી અને ૧૬૩પ વાડીઓમાં જે પૈસા આપવા જોઇએ તે અપાયા જ નથી.

        આદિવાસી સમાજને સૌથી મોટો અન્‍યાય આ સરકાર કરી રહી છે. વનસંપતિ પરના અધિકારોનો કાયદો કેન્‍દ્ર સરકારે આપ્‍યા પછી પણ આદિવાસી સમાજને હક્કપત્રો હજુ સુધી આપવામાં આવ્‍યા નથી. આદિવાસી ભાઇઓની જમીન ધનપતિઓ ખરીદી લે અને જમીનનો આદિવાસી માલીક મજૂર બની જાય તેવા કાવતરા પણ આ સરકાર કરી રહી છે. જેમ કોઇ પ્રાણી ભયના કારણે કલર અથવા સીઝનના કારણે કલર બદલે તે રીતે ગુજરાતની સરકાર પણ પોતાના કલર બદલે છે. રાજ્યપાલશ્રીના પ્રવચનમાં લઘુમતી માટેની વાત કરવામાં આવી છે પરંતુ સત્‍ય હકીકત એ છે કે, માનનીય વડાપ્રધાનના કાર્યક્રમના અમલીકરણ માટે  અન્‍ય રાજ્યોને એકસલન્‍ટ અથવા વેરીગુડના પ્રમાણપત્રો આપવામાં આવ્‍યા ત્‍યારે ગુજરાત આ પ્રકારનું પ્રમાણપત્ર મેળવી શક્યુ નથી. સાચર કમિટીના અહેવાલની હોળી કરનારા લોકો હવે સાચર કમિટીની વાતો કરી રહ્યાં છે. ગુજરાતમાં લઘુમતી પર સૌથી વધારે હુમલાઓ થાય છે. ર૦૦૬-૦૭માં ૧ર૪૪ હુમલાઓ લઘુમતી ઉપર થયા હતાં અને તે ઘટવાના બદલે ર૦૦૭-૦૮માં ૧૩૭ર ગુન્‍હાઓ લઘુમતી ઉપર હુમલાના બનેલાં છે. રાજય સરકાર કોઇ રક્ષણ લઘુમતીને આપવા માંગતી નથી.

        ગુજરાતની સરકાર બંધારણીય જવાબદારીઓથી વિપરીત થતી રહી છે. માનવ અધિકાર પંચને યોગ્‍ય કર્મચારી કે અધિકારી આપવામાં આવતાં નથી. આર.ટી.આઇ.કમિશનના કાર્યબોજને જોતાં વધારે આર.ટી.આઇ.કમિશ્નરો મૂકવા જોઇએ. લોકાયુક્તની નિમણુંક કરવામાં આવતી નથી. વિરોધપક્ષને મળતું ઉપાધ્‍યક્ષનું બંધારણીય પદ વર્ષોથી ખાલી છે, જે બધાજ મુદ્દાઓ બંધારણના અને લોકશાહીના અપમાન સમાન છે.

        ગુજરાતમાં કાયદો અને વ્‍યવસ્‍થા સંપૂર્ણ કથળી ગયેલી છે. ઉમરેઠ ખાતે એક બુટલેગરની સામે લખાણ કરનાર પત્રકારને પોલીસ દ્વારા ઢોર માર મારવામાં આવ્‍યો હતો અને છતાં તે પોલીસની સામે કોઇ પગલા લેવામાં આવ્‍યા નથી.

પોરબંદરમાં મુળુભાઇ મોઢવાડીયાની હત્‍યામાં સંડોવાયેલા આરોપીઓને હથિયાર લાયસન્‍સો આપીને ગુજરાતની સરકારે સન્‍માનિત કરવાનું પાપ્ કરેલું છે. કચ્‍છમાં પોતાની જમીન માટેની લડત લડતાં  શ્રી જબ્‍બરદાન ગઢવીને આ સરકારે ન્‍યાય આપ્‍યો નથી કે તેનો જીવ બચાવવાનો પ્રયત્‍ન કરેલો નથી.

        રાજયમાં શિક્ષણનું સ્‍તર સદંતર કથળી રહ્યું છે. ટેકનિકલ એજ્યુકેશન લીધેલાં વિદ્યાર્થીઓ બેકાર રખડે છે, કારણ કે, રાજ્યમાં  ટેકનિકલ શિક્ષણ આપતાં પ્રિન્સિપાલ, પ્રોફેસર, લેકચરર વિગેરેની ૭૦ ટકા જગ્‍યાઓ કરતાં વધારે જગ્‍યાઓ એન્‍જીનીયરીંગ અને પોલીટેકનીકમાં ખાલી છે. આ જગ્‍યાઓ તાત્‍કાલિક એડહોક ધોરણે ભરીને ચાલુ રાખી શકવાની સરકારને ચિંતા નથી. ભાવનગરની કે.જે.મહેતા મેડીકલ કોલેજમાં ભણતાં વિદ્યાર્થિઓનું એક વર્ષ પછી ભવિષ્‍ય મુશ્‍કેલીમાં મુકાયું છે ત્‍યારે તેની ચિંતા પણ ગુજરાતની સરકાર નથી કરતી.

         રાજ્યના મુખ્‍યસચિવશ્રીને ગુજરાતના જ એક હિન્‍દુ અધિકારી પત્ર લખીને મુખ્‍યમંત્રીશ્રીના ભ્રષ્‍ટાચાર અને અનૈતિક સબંધોની વાત કરી છે ત્‍યારે જો મુખ્‍યમંત્રી અણીશુધ્‍ધ હોય તો તેમણે તટસ્‍થ તપાસ સામેથી આપવી જોઇએ. સુપ્રિમ કોર્ટના સીટીંગ અથવા નામદાર સુપ્રિમ કોર્ટની બનાવાયેલી એસ.આઇ.ટી કે સી.બી.આઇ. મારફત તપાસ થવી જોઇએ તેવી માંગણી પણ વિરોધપક્ષના નેતાએ કરી હતી.

• Congress has supported the provision of 50 per cent reservation for women in local self governments because it was in accordance of its policies.
• Compulsory voting is against fundamental constitutional freedom.
• Chief Minister himself rarely remains present during voting in the House. How can he impose compulsory voting on others?
• Late Rajiv Gandhi had initiated reservation for women by making constitutional amendments.
• Even the countries which have experimented with the idea of compulsory voting are now scrapping it.
• Ruling BJP is doing injustice to women by clubbing reservation with compulsory voting in the Bill.
• The state government has squandered Rs 500 lakh, the centre had given to it for women welfare.

 BJP ruled Gujarat government today passed a  Bill having both reservation for women in local self government and compulsory voting in one despite clear instructions from the Governor that both should be separated.

Earlier Governor had also asked the government to reconsider its proposal of compulsory voting while returning the Bill passed by the government. Despite this, government today passed the Bill on the basis of its majority. This is
an insult of democratic system, said Leader of Opposition in the Assembly, Shri Shaktisinh Gohil.

He said that the Congress was in favour of 50 percent reservation for women in local self government. But, the government is attaching the proposal of compulsory voting in a very arbitrary manner. Congress is against compulsory voting because it is against the basic constitutional provision of freedom of individual. Gohil pointed out that even Dinesh Goswami committee appointed by Lok Sabha did not favour the idea of compulsory voting.

The law of compulsory voting proposed by the government will adversely affected villagers, dalits, poor and middle class. Rich and influential people can get exemption if they have to go abroad but not the poor who has to migrate for seasonal labour , Gohil pointed out. He is to be punished under the new law to be enacted.

Some countries have experimented with the idea of compulsory voting, but later retracted.

Gohil cited the case of Austria where compulsory voting was introduced in President’s election in 1929 and in 1949 in the Parliament. However, Austria realized that the compulsory voting was undemocratic and it withdrew it in a phased manner ranging from 1982 to 2004. Netherlands introduced it in 1917, but scrapped it in 1970. Spain had a brief encounter with the idea from 1907 to 1923. There is a movement against compulsory voting in Australia.

A private member Bill for compulsory voting was rejected by the Parliament.

In the past Congress in Gujarat had made facilities for free education to women in all fields. But today education in Gujarat is totally being commercialized and the BJP government has eliminated the idea of free education to women.

Girl fetuses are being killed in large numbers in Gujarat and the government has no concrete plans for save the girl child campaign.

According to Article 19(1) (k) of the constitution every citizen has freedom of expression. As per this provision a voter has the right to express his unwillingness to vote in favour of someone. Compulsory voting violates this fundamental freedom of citizens.

The government is not able to provide voting slips to the voters with details like voters name, where he is registered and when and where he has to vote. If the administration cannot provide voting slips how can it implement compulsory voting, Gohil wondered.

The Bill does not specify the type of action to be initiated against person not casting vote. Legally, it is not right for the government or the administration to keep with itself the right to punish.

• વિધાનસભામાં માન.મુખ્‍યમંત્રીશ્રી એક મતદાર હોવા છતાં ગૃહમાં મતદાન સમયે ભાગ્‍યેજ હાજર રહે છે. તેમને શુ અધિકાર છે કે રાજ્યના મતદારોને મતદાન માટે ફરજ પાડે.
• મહિલાઓ માટે અનામતની જોગવાઇ કરવા બંધારણીય સુધારો કરીને પહેલ કરનાર સ્‍વ.રાજીવ ગાંધી હતાં.
• જે દેશોએ ફરજીયાત મતદાનનો અખતરો કર્યો હતો તેઓ પણ ફરજીયાત મતદાનમાંથી પરત ફરી રહ્યાં છે.
• ફરજીયાત મતદાનનો તઘલખી સુધારો મહિલા અનામત સાથે મૂકીને ભા.જ.પ સરકાર સમગ્ર બિલને ખોરંભે પાડી મહિલાઓને અન્‍યાય કરવા માંગે છે.
• મહિલા કલ્‍યાણ માટે કેન્‍દ્રમાંથી આવેલા પ૦૦ લાખ રુપિ‍યા ગુજરાતના મુખ્‍યમંત્રીશ્રીએ પોતાના ભાષણો કરવામાં વાપરી નાખ્‍યા.

માનનીય રાજ્યપાલશ્રીએ મહિલા અનામત બિલ અલગ રીતે રજુ કરવા અને ફ‍રજીયાત મતદાન બંધારણીય રીતે ઉચિત ન હોઇ પુનઃ વિચારણા કરવા જણાવેલું હોવા છતાં ગુજરાતની ભા.જ.પ.ની સરકારે મહિલા અનામત અને ફરજીયાત મતદાનનું વિધેયક બહુમતિના જોરે વિધાનસભામાં પસાર કરીને લોકશાહી બંધારણીય વ્‍યવસ્‍થાનું અપમાન કરેલ છે.

ગુજરાત વિધાનસભામાં  આજે વિધેયક ક્રમાંક-ર૩ દાખલ થયેલું હતું. આ વિધેયક દ્વારા મહિલાઓને પ૦ ટકા અનામતની જોગવાઇ કરવામાં આવી હતી. કોંગ્રેસપક્ષના સભ્‍યોએ મહિલા અનામતની જોગવાઇઓને સમર્થન આપ્‍યું છે. મહિલા અનામતની જોગવાઇઓ સાથે કોઇપણ કારણ વગર ફરજીયાત મતદાન માટેની જોગવાઇ ભા.જ.પ.ની સરકારે દાખલ કરવાનો તઘલખી નિર્ણય કરેલો અને તેથી કોંગ્રેપક્ષે તેનો વિરોધ કરેલો છે. બંધારણની નાગરિક સ્‍વાતંત્રતાથી તદ્દન વિરુધ્‍ધ ફરજીયાત મતદાનની જોગવાઇઓ છે. દેશની પાર્લામેન્‍ટે પણ તેની વિચારણા કરી છે તેવા દિનેશ ગૌસ્‍વામી કમિટીના રીપોર્ટમાં ફરજીયાત મતદાન વાસ્‍તવિક નહીં હોવાનો ઉલ્‍લેખ છે. ફરજીયાત મતદાનની નકારાત્‍મક અસર માત્ર ગ્રામ્‍ય વિસ્‍તારોના ગરીબ, મધ્‍યમ વર્ગ, આદિવાસી અને દલિતોને થશે. કાયદાની જોગવાઇઓ મુજબ શ્રીમંત માણસ પરદેશ ગયો હોય કે રાજ્યની બહાર હોય તો તેને ફરજીયાત મતદાનમાંથી મુક્તિ મળી જાય છે પણ ગરીબ માણસ ગામતરે ગયો હોય તો તેને શિક્ષા કરવાની જોગવાઇ છે. દુનિયામાં થોડા દેશોએ ફરજીયાત મતદાનનો અખતરો કર્યો હતો. પરંતુ પસ્‍તાઇને તેમાંથી પાછા ફરી રહ્યાં છે. ઓસ્‍ટ્રીયામાં ૧૯ર૯માં પ્રેસીડેન્‍સીયલ ઇલેકશનમાં અને સન-૧૯૪૯થી રાજ્યમાં સંસદની ચૂંટણીમાં ફરજીયાત મતદાનનો કાયદો આવેલો હતો. પરંતુ અનુભવે ઓસ્‍ટ્રીયાને લાગ્‍યુ કે લોકશાહી માટે ફરજીયાત મતદાન નુકશાનકર્તા છે. કોઇને જબરજસ્‍તીથી મતદાન કરવા મોકલવાથી જાગૃત મતદારોને સમજણપૂર્વકના અવાજને અન્‍યાય થઇ જાય છે. તેમજ લોકશાહીના મૂળભૂત સિધ્‍ધાંતો અને અધિકારનો ભંગ થાય છે. ઓસ્‍ટ્રીયાએ સન-૧૯૮ર થી ર૦૦૪ વચ્‍ચે તબકકાવાર પોતે જે ફરજીયાત મતદાન કાયદો બનાવ્‍યો તેને રદ કરેલ છે. આમ ઓસ્‍ટ્રીયા જેવા દેશે ફરજીયાત મતદાનનો કાયદો બનાવ્‍યો પણ તેને રદ કરવો પડ્યો છે. નેધરલેન્‍ડ(હોલેન્‍ડ)એ ૧૯૧૭માં ફરજીયાત મતદાનનો કાયદો કર્યો હતો પરંતુ અનુભવે કાયદો યોગ્‍ય ન હોય સન-૧૯૭૦માં ફરજીયાત મતદાનનો કાયદો રદ કર્યો છે. સ્‍પેન દ્વારા સન-૧૯૦૭ થી ૧૯ર૩ વચ્‍ચે ફરજીયાત મતદાનનો કાયદો કરેલો પરંતુ તેને લાગુ કરવો યોગ્‍ય ન જણાતાં તેને લાગુ કરવામાં આવ્‍યો નહીં. ઓસ્‍ટ્રેલીયામાં પણ ફરજીયાત મતદાનની વિરુધ્‍ધ મોટા પાયે મુવમેન્‍ટ ચાલી રહી છે.

        દેશની સંસદમાં ખાનગી સભ્‍યો દ્વારા ફરજીયાત મતદાનનું બિલ દાખલ થયેલું. પરંતુ તેને પણ દેશની સંસદે અમાન્‍ય ઠરાવેલું છે.

        ગુજરાતમાં મહિલાઓના કલ્‍યાણ માટે ભૂતકાળમાં તમામ ક્ષેત્રે મફત શિક્ષણ મહિલાઓને મળે તેવી વ્‍યવસ્‍થા કોંગ્રેસની સરકારે હતી. પરંતુ આજે ગુજરાતમાં શિક્ષણનું વ્‍યવસાયીકરણ થઇ રહ્યું છે અને મહિલાઓને મફત શિક્ષણની વાત ગુજરાતની ભા.જ.પ સરકારે અભરાઇએ ચડાવી છે. ગુજરાતમાં મોટા પાયે ભ્રુણ હત્‍યા થાય છે અને ખરા અર્થમાં બેટી બચાવ માટે સરકારનું કોઇ આયોજન નથી.

ભારતના બંધારણના અનુચ્‍છેદ ૧૯(૧)(ક)માં અભિવ્‍યકતીની સ્‍વતંત્રતા દર્શાવેલી છે. આ બંધારણીય અધિકારમાં કોની તરફેણમાં પોતાનો મત નહીં આપવાની મતદારની અભિવ્‍યકિતનો પણ અધિકાર સમાયેલો છે. ફરજીયાત મતદાન દ્વારા આ બંધારણીય અધિકારનો પણ ભંગ થાય છે.

        સરકારી તંત્ર દ્વારા  મતદારોને મતદાન સ્‍લીપમાં એટલે કે, મતદાર કયાં નોંધાયેલ છે અને તેઓએ કઇ જગ્‍યાએ કઇ તારીખે મત આપવાનો છે તેની સ્‍લીપબુક હાલ પહોંચાડાતી નથી. સરકારી તંત્ર જો આ વ્‍યવસ્‍થા ન કરી શકતું હોય તો મતદારની ઉપર ફરજીયાત મતદાનની ફરજ પાડવી તે કોઇપણ હિસાબે વ્‍યાજબી નથી.

        મતદાર જો મત ન આપે તો તેને શું શિક્ષા કરવી તે અંગેની કોઇ જોગવાઇ બિલમાં કરવામાં આવી નથી. દંડનીય જોગવાઇ કરવાનો અધિકાર સરકાર પોતાની પાસે કે તંત્ર પાસે રાખે તે કાનૂની રીતે પણ યોગ્‍ય નથી.

Leader of Opposition Shaktisinh Gohil today blasted Gujarat government for the tax burden of Rs 524 crore. People expected relief in professional tax and VAT and several other fields. It should have given relief to people in the golden jubilee year. But Gujarat government has introduced new taxes that are going to cause inflation. Gujarat has maximum VAT in the country. Relief in the VAT is bound to reduce prices. But government has not bothered to give relief in the VAT, Gohil pointed out. In addition to very high VAT, there is surcharge on it. Nowhere else surcharge is taken on VAT. People had expected relief in this, but nothing has come out.

Gohil described the budget a jugglery of figures. Deficit budget has been presented as a surplus budget. This is just by changing the head of revenue loss from major to minor. Giving an example of this jugglery he said that in 2008-09 there was a surplus of Rs 286.56 crore. However, the real figure for that year turns out to be deficit of Rs 65.75 crore. Similarly, he said, in the year 2009-10 deficit on revenue account was shown as 3913.19 crore which according to revised estimates has turned out to be Rs 4356.50 crore. Government is misleading people by providing false business estimate.

CAG the constitutional body has severely criticized Gujarat government for its tendency of borrowing. It has asked Gujarat government not to go for borrowing otherwise within ten years its entire economy and fiscal policies will collapse. It is unfortunate that instead of taking measures to reduce the debt burden, Gujarat government has caused to increase it debt by Rs 21125.87 crore within one year. It is a record in the history of Gujarat. Gujarat government has increased tax on the ground that other states had higher rate of taxation. It should have used the same logic in the case where Gujarat has higher rate of taxation as compared to other states, Gohil said.

 Gujarat has the longest coastline in the country. The development and security of the coastline is necessary for the state and the country. With increase in the size of the budget it is necessary that the allocation for security of bordering coastline should also be increased. But this year the funds for development of border areas has decreased considerably and only 0.36 percent has been allocated. This shows that the Chief Minister is ignoring the border areas and he wants that terrorists come to Gujarat and India. In case of any terrorist activity he can politicize the issue and make his vote bank stronger.

 In the name of green energy, government has signed contracts for purchase of electricity from private players at very high rates and it has imposed burden of Rs 244 crore on people through cess.

 The funds allocated in the budget for various poor and rural development schemes remain unutilized. During the last four years though crores of rupees were allotted for social services, rural and agriculture development and other services a huge amount is left unspent. The schemes are only on paper and the government is misleading people.

 Many promises are made to the people in the budget. But no work is done and same are repeated in the next year. For instance metro train between Ahmedabad-Gandhinagar was announced last year but nothing has moved. Kalpsar project is mentioned in budget for last few years but even the feasibility report has not been prepared. There are many instances where people are being misled.

 There is huge quantity of water in Narmada in Gujarat. During Congress rule more than 17,000 km canal work was completed. The remaining work was to be completed by the BJP government in 2004, but the BJP has failed to provide water to the farmers. During the last two years work of laying only 580 km has been completed and still 4144 km work is remaining. Adequate funds have not been provided in the budget for the completion of these works.

• કેગ દ્વારા ના પડાયા છતાં આ બજેટમાં ગુજરાતની સરકાર ર૧,૧રપ.૮૭ કરોડ રુપિ‍યાનું દેવું વધારશે.
• ગ્રીન એનર્જીના નામે પંદર રુપિ‍યે વિજળીની ખરીદીના કોન્‍ટ્રાકટ કરી મોટા ઉદ્યોગપતિઓને લાભ આપવા ગુજરાતની જનતા પર ગ્રીન સેસના     નામે ર૪૪ કરોડનો કરબોજ.
• ગ્રામીણ, ગરીબ, આદિવાસી, દલિત અને લઘુમતિ માટે ફળવાયેલા નાણાં વણવપરાયેલાં રહે છે.

ગુજરાત વિધાનસભામાં રજૂ થયેલું આજનું બજેટ ગુજરાતની જનતાને રાહત આપવાના બદલે પર૪ કરોડના કરબોજનું રજૂ કરવામાં આવ્‍યું. ગુજરાત વિધાનસભા વિરોધપક્ષના નેતાશ્રી શક્તિસિંહ ગોહિલે સ્‍વર્ણિમ વર્ષમાં વેટ અને પ્રોફેશનલ ટેક્ષથી માંડીને અનેક બાબતોમાં રાહતની અપેક્ષાએ બેઠેલી ગુજરાતની જનતાને કમરતોડ કરબોજ આપીને મોંઘવારી વધારનારા બજેટ તરીકે આજના બજેટને ગણાવ્‍યું હતું. ગુજરાતની જનતા ઉપર દેશના કોઇપણ રાજ્ય કરતાં વધારે વેલ્‍યુએડેડ ટેક્ષ(વેટ)નું ભારણ છે, આ વેટના દર નીચા લાવવામાં આવે તો જ ગુજરાતમાં મોંઘવારી ઘટે. ગુજરાત સરકારે વેટના દેશમાં સૌથી વધારે દર હોવાછતાં તેને ઘટાડવા માટે કોઇપણ જાતના પગલાં આ બજેટમાં જાહેર કર્યા નથી. કમરતોડ વેટના ઉપરાંત રપ ટકાનો સરચાર્જ ગુજરાતની જનતા ઉપર નાંખવામાં આવેલો છે. સમગ્ર દેશમાં કોઇપણ જગ્‍યાએ વેટ ઉપર આવો કમરતોડ સરચાર્જ નથી. ગુજરાતની જનતાની આશા અને અપેક્ષા હતી કે આ વર્ષે વેટ ઉપરનો સરચાર્જ ઘટશે અને જનતાને રાહત થશે, પરંતુ પ્રજાની આ આશા પણ આ બજેટમાં ઠગારી નીવડી છે.

કેન્‍દ્ર સરકારની યોજનાઓને પોતાના નામે ચડાવીને જાહેરાતો કરનારી ગુજરાતની સરકારે રાજ્યના સમતુલિત વિકાસ માટે નાણાની ફાળવણી યોગ્‍ય રીતે કરી નથી. ગુજરાતની જનતાને ગુમરાહ કરવા માટે ખોટા અંદાજો દર્શાવવામાં આવે છે અને ખાધવાળા બજેટને પુરાંતવાળા તરીકે તેમજ મોટી મહેસૂલી ખાધને ખોટી રીતે નાની મહેસૂલી ખાધ દર્શાવવાની રાજ્ય સરકારની મેલી ચાલ પણ આ બજેટમાં ઉજાગર થાય છે. સન-ર૦૦૮-૦૯માં મહેસૂલી હિસાબ ઉપર ર૮૬.પ૬ કરોડ રુપિ‍યાની પુરાંત છે તેમ કહીને મોટા બણગાં ફૂંકવામાં આવ્‍યા હતાં. પરંતુ આજના બજેટમાં ર૦૦૮-૦૯ના ચોખ્‍ખા હિસાબો રજૂ થયા ત્‍યારે એ વાત સ્‍પષ્‍ટ થઇ કે, ર૦૦૮-૦૯માં પુરાંત નથી પરંતુ મહેસુલી હિસાબ ઉપર ૬પ.૭પ કરોડ રૂપિ‍યાની ખાધ છે. તેજ રીતે ર૦૦૯-૧૦ના વર્ષના બજેટમાં મહેસુલી ખાધ રુપિ‍યા ૩૯૧૩.૧૯ કરોડની બતાવેલી હતી, પરંતુ આજના બજેટમાં રજુ થયેલાં સુધારેલા અંદાજ મુજબ મહેસુલી ખાધ ૪૩પ૬.પ૦ કરોડ રુપિ‍યા થઇ ગઇ છે. આમ રાજ્ય સરકાર જાણી જોઇને ગુજરાતની જનતા પાસે ખોટા અંદાજો રજૂ કરીને પ્રજાને ગુમરાહ કરે છે.

તટસ્‍થ બંધારણીય સંસ્‍થા કેગ દ્વારા કડક ટીકા કરવામાં આવી છે કે, ગુજરાતની સરકારે હવે દેવું વધારવું ન જોઇએ. કેગ દ્ગારા લખાયું છે કે, જો ગુજરાતની સરકાર દેવું લેવાની પ્રવૃત્તિ નહીં ઘટાડે તો દસ વર્ષ પછી ગુજરાતના નાણાકીય રીતે છેડા ભેગા થઇ શકશે નહીં અને રાજ્યનું અર્થતંત્ર અસ્‍તવ્‍યસ્‍ત થઇ જશે. આમ છતાં, ગુજરાત સરકારે આ બજેટમાં દેવું ઘટાડવાના બદલે ર૧૧રપ.૮૭ કરોડ રુપિ‍યાનું જાહેર દેવું વધારેલું છે. ગુજરાતના પ૦ વર્ષના ઇતિહાસમાં આટલું મોટું દેવું એક જ વર્ષમાં કોઇપણ સરકારે લીધેલું નથી. આટલી મોટી રકમ દેવા પેટે લીધા છતાં ગુજરાતની જનતાને કરવેરામાં કોઇપણ જાતની રાહત આપી નથી અને ઉલ્‍ટાનું રાજ્યની જનતા ઉપર કરોડો રુપિ‍યાનો નવો કરબોજ નાખેલો છે. અન્‍ય રાજ્યોમાં તમાકુ પરનો વેરો વધારે છે તેમ કહીને ગુજરાતમાં વેરો વધારવામાં આવ્‍યો છે, પરંતુ અનેક આઇટમોમાં દેશના અન્‍ય રાજ્યોમાં વેરાની રકમ ઓછી છે તો ગુજરાતમાં વેરો ઘટાડવાની સરકાર ચિંતા કરતી નથી.

ગુજરાત સૌથી મોટો દરિયાઇ સરહદી વિસ્‍તાર ધરાવે છે અને સરહદી વિસ્‍તારનો વિકાસ રાજ્ય અને
રાષ્‍ટ્રની સલામતી માટે પણ અત્‍યંત જરુરી છે. બજેટના કદની સાથે સરહદી વિસ્‍તાર વિકાસ કાર્યક્રમ માટે નાણા વધારે ફાળવવા જોઇએ. તેના બદલે સરહદી વિસ્‍તાર વિકાસ કાર્યક્રમમાં ગયા બજેટમાં ફાળવાયેલા નાણામાં ખૂબ જ મોટો ઘટાડો કરીને માત્ર ૦.૩૬ ટકા જ રકમ ફાળવવામાં આવી છે. આ બતાવે છે કે, મુખ્‍યમંત્રીશ્રી સરહદી વિસ્‍તારની અવગણના કરીને સરહદો પરથી આતંકવાદીઓ ગુજરાત અને દેશમાં આવે તેવું ઇચ્‍છી રહ્યાં છે. આતંકવાદી આવે અને કોઇ આતંકવાદી ઘટના બને તો જ મુખ્‍યમંત્રીશ્રીનું આતંકવાદના નામે રાજકારણ ચાલે અને પોતાની વોટ બેન્‍કની રાજનીતિ તેઓ ખેલી શકે.

ગુજરાતમાં ગ્રીન એનર્જીના નામે પોતાના માનીતા ઉદ્યોગપતિઓને માલામાલ કરવા માટે ૧પ રુપિ‍યા પ્રતિ યુનિટ વિજળી ખરીદવાના ગુજરાતની સરકાર કોન્‍ટ્રાકટ કરે છે જયારે આ જ વિજળી કેન્‍દ્ર સરકારના સાહસ પાસેથી માત્ર ર.૯ રુપિ‍યામાં મળે છે. ગ્રીન એનર્જીના નામે પંદર રુપિ‍યે યુનિટ વિજળી ખરીદાય છે તેના કારણે જે નાણાની જરુર પડવાની તે આમ ગુજરાતી પાસેથી જ વસુલ કરવા માટે જ ગ્રીન સેસના નામે ર૪૪ કરોડ રુપિ‍યાનો કરબોજ આ બજેટમાં વિજળી વાપરતા ઉપભોક્તાઓ પાસેથી ઉત્‍પાદનના સ્‍તરે જ બે પૈસાના દરે ટેક્ષ વસુલ કરવાનું આયોજન કરવામાં આવ્‍યું છે.

ગુજરાત સરકાર બજેટની જોગવાઇના જે આંકડાઓ બજેટ પ્રવચનમાં દર્શાવે છે, જયારે ખરેખર ખર્ચ કરવાનો હોય છે ત્‍યારે ગરીબ અને ગ્રામીણલક્ષી યોજનાઓમાં આ ખર્ચ કરવામાં આવતો નથી અને કરોડો રુપિ‍યા વપરાયા વગરના રહે છે તે વાતનો પર્દાફાશ છેલ્‍લાં ચાર વર્ષના બજેટનાં આંકડાઓ જોઇએ તો સામાજીક સેવાઓ, ગ્રામીણ વિકાસ, કૃષિ‍ અને સંલગ્‍ન સેવાઓમાં ફાળવાયેલી રકમ કરતાં અનેકગણો ઓછો ખર્ચ કરીને સરકારે બજેટ પ્રવચનમાં કરેલી જાહેરાતો માત્ર કાગળ ઉપર રહી છે અને લોકોને લોલીપોપ આપવાનું કામ કર્યુ છે.

ગુજરાતના લોકોને બજેટ પ્રવચનમાં કેટલાંક વચનો આપી દેવામાં આવે છે. પરંતુ પછી પ્રગતિ જયાંની ત્‍યાં જ રાખીને બજેટ પ્રવચનમાં બીજા વર્ષે પણ એની એ જ વાત કરવામાં આવે છે. જેમ કે, ગાંધીનગર-અમદાવાદ વચ્‍ચે મેટ્રો ટ્રેનની વાત અગાઉ પણ બજેટ પ્રવચનમાં થઇ પરંતુ ત્‍યારબાદ પ્રગતિ શૂન્‍ય છે. કલ્‍પસર યોજનાના નામે છેલ્‍લાં કેટલાંય વર્ષોથી બજેટ પ્રવચનમાં વાતોના વડા થાય છે. પરંતુ પ્રિફીઝીબીલીટી રિર્પોટ પણ હજુ સુધી સરકારે તૈયાર કરેલો નથી. આવી અનેક બાબતો છે કે, જેમાં માત્ર પ્રજાને ગેરમાર્ગે દોરવાના પ્રયત્‍નો જ કરવામાં આવેલ છે.

ગુજરાતમાં નર્મદા ખાતે પુષ્‍કળ પાણી ઉપલબ્‍ધ છે. કોંગ્રેસના શાસનમાં ૧૭૦૦૦ કિ.મી. કરતાં વધારે નર્મદાની નહેરનું કામ પરિપૂર્ણ કરવામાં આવ્‍યું હતું. બાકી રહેતી નહેરોનું કામ ર૦૦૪ સુધીમાં સંપૂર્ણ પૂરું કરવાની જવાબદારી ભાજપની સરકારની હતી, પરંતુ નર્મદા યોજનામાં ખેડૂતોને પાણી પહોંચાડવાનું કામ ભાજપની સરકાર કરી શકી નથી. છેલ્‍લાં બે વર્ષમાં માત્ર પ૮૦ કિ.મી.ની નહેરોનું કામ થયું છે અને હજી ૪૧૪૪ કિ.મી. કેનાલોનું કામ બાકી છે. આ કામને પહોંચી વળવા પૂરતાં નાણાની જોગવાઇ બજેટમાં કરવામાં આવી નથી.

• Congress supports election of Speaker of Gujarat Assembly.
• To maintain the excellent parliamentary traditions Congress has supported the proposal of Speaker.
• As per the tradition deputy Speaker post should be given to Congress.
• Congress hopes impartial stand by the new Speaker in the House.
• The opposition in the Assembly should be given due respect at par with the opposition in Lok Sabha.
• The UPA government led by Congress or the Speaker of Lok Sabha has never suspended the opposition even for a day. Gujarat should also follow the system.

Congress has supported the candidature of Shri Ganpat Vasava as the Speaker of the Assembly. The Congress has shown care and sportsmanship to maintain the rich parliamentary traditions of Gujarat. At the same time Congress hopes and has demanded that the deputy Speaker post should be given to it.

Speaker of the Assembly has the responsibility to conduct the proceedings of the house neutrally. The glory of Gujarat Assembly having legacy of Shri Purushottam Mavlankar is well known in the country. In the past late Shri Raghavji Levua, late Shri Natwarlal Shah Shri Barjorji Pardiwala established themselves as impartial and efficient Speakers in the House. They conducted the House in such a way so as to ensure that the voice of Opposition was not stifled and constitutional traditions were followed.

Gujarat Congress hopes that the new Speaker will also follow the traditions and conduct the proceedings in a neutral way. Leader of opposition Shaktisinh Gohil, former leader Arjun Modhavadhia, Party President Siddharth Patel, deputy leader Shri Mohansinh Rathwa, whip Shri Iqbal Patel and other leaders congratulated Shri Vasava and expected that he would act impartially.

The opposition in the Lok Sabha disrupted the House for several days but still nor the Congress led UPA government neither the Speaker suspended them even for a day. The UPA government has the attitude to compromise and has given due respect to the opposition. The opposition party in Gujarat hopes that same tradition will be followed here.

•   ગુજરાતની ઉમદા સંસદીય પ્રણાલિકાઓને જાળવી રાખીને કોંગ્રેસપક્ષે અધ્‍યક્ષ માટેના પ્રસ્‍તાવને સમર્થન આપ્‍યું.
•   ગુજરાતની પ્રસ્‍થાપીત પ્રણાલિકાઓ મુજબ ઉપાધ્‍યક્ષનું પદ કોગ્રેસને આપવું જોઇએ.
•   વિધાનસભામાં તટસ્‍થ સંચાલન માટે નવા અધ્‍યક્ષશ્રી પાસે કોંગ્રેસપક્ષની અપેક્ષા.
•   જે રીતે લોકસભામાં વિરોધપક્ષને પુરતુ માન અને સન્‍માન મળે છે તેજ રીતે વિધાનસભામાં વર્તન થાય તેવી માંગ.
•   કોંગ્રેસની આગેવાનીવાળી યુ.પી.એ.ની સરકાર કે લોકસભાના અધ્‍યક્ષ વિરોધપક્ષના સભ્‍યોને એક દિવસ માટે પણ સસ્‍પેન્‍ડ કરતાં નથી   તેવું વર્તન ગુજરાતમાં થવું જોઇએ.

         ગુજરાત વિધાનસભાના અધ્‍યક્ષ તરીકે શ્રી ગણપતભાઇ વસાવાના ઉમેદવારીપત્રને કોગ્રેસપક્ષ તરફથી સમર્થન આપવામાં આવ્‍યુ હતું. ગુજરાત વિધાનસભાની ઉમદા પરંપરાઓને જાળવી રાખવાની કોંગ્રેસપક્ષે પૂરતી ખેવના અને ખેલદિલી રાખી છે. સાથોસાથ વિધાસનભા કોંગ્રેસપક્ષે સત્તાધારી પક્ષ પાસેથી અપેક્ષા રાખી છે અને સ્‍પષ્‍ટ માંગણી કરી છે કે, વિધાનસભાના ઉપાધ્‍યક્ષનું પદ પરંપરાગત રીતે વિરોધપક્ષને આપવામાં આવે છે તો તે પરંપરાનું પાલન કરીને વિધાનસભાના ઉપાધ્‍યક્ષનું પદ કોંગ્રેસને આપવામાં આવે.

        વિધાનસભાના અધ્‍યક્ષ અધ્‍યક્ષસ્‍થાને રહીને તટસ્‍થતાથી ગૃહનું સંચાલન કરવાની જવાબદારી નિભાવતા હોય છે. સ્‍વ.પુરષોત્તમ માવલંકરજીના વારસા સાથે જોડાયેલી ગુજરાતની વિધાનસભાનું ગૌરવ સમગ્ર દેશમાં અગ્રેસર હતું. ભૂતકાળમાં સ્‍વ.શ્રી રાઘવજી લેઉવા તથા સ્‍વ.શ્રી નટવરલાલ શાહ અને શ્રી બરજોરજી પારડીવાલા જેવા મહાનુભાવોએ અધ્‍યક્ષસ્‍થાને રહીને એક તટસ્‍થ અને ઉમદા અધ્‍યક્ષ તરીકેની પ્રતિભા પ્રસ્‍થાપીત કરી હતી. વિરોધપક્ષનો અવાજ ન રુંધાય  અને બંધારણીય પરંપરાનું પુરું પાલન થાય તે રીતે તટસ્‍થતાથી તેઓએ ગૃહનું સંચાલન કર્યુ હતું.

        વિધાનસભા કોગ્રેસપક્ષે નવા વરાયેલા અધ્‍યક્ષ પણ તટસ્‍થતાથી ગૃહનું સંચાલન કરીને ગુજરાતની ઉમદા પ્રણાલિકાઓને જાળવી રાખશે તેવી આશા વ્‍યક્ત કરી હતી. નવા વરાયેલા અધ્‍યક્ષશ્રીને વિરોધપક્ષના નેતાશ્રી શક્તિસિંહ ગોહિલ, પ્રદેશ કોંગ્રેસ સમિતિના પ્રમુખશ્રી સિધ્‍ધાર્થભાઇ પટેલ, પૂર્વ નેતાશ્રી અર્જુનભાઇ મોઢવાડિયા, ઉપનેતાશ્રી મોહનસિંહ રાઠવા, દંડકશ્રી ઇકબાલભાઇ પટેલ વિગેરેનાઓએ અભિનંદન પાઠવીને ગૃહનું સંચાલન લોકશાહી ઢબે ચાલશે તેવી આશા વ્‍યક્ત કરી હતી.

         લોકસભામાં વિરોધપક્ષે આક્રોશપૂર્ણ રીતે ગૃહની કાર્યવાહી ઘણાં દિવસો સુધી ખોરવી નાખે છે છતાં પણ કોંગ્રેસની આગેવાનીવાળી યુ.પી.એ.ની સરકારે કે, લોકસભાના માનનીય અધ્યક્ષશ્રી દ્વારા એક દિવસ માટે પણ વિરોધપક્ષના સભ્‍યોને સસ્‍પેન્‍ડ કરવામાં આવતા નથી. વિરોધપક્ષની લાગણી સામે કેન્‍દ્રની યુ.પી.એ.ની આગેવાનીવાળી સરકારે સમાધાનકારી વલણ અપનાવીને પણ વિરોધપક્ષનું માન અને સન્‍માન જાળવેલ છે. તેજ રીતની પરંપરા ગુજરાતમાં પણ પ્રસ્‍થા‍‍પીત થાય તેવી આશા વિધાનસભા કોંગ્રેસપક્ષે વ્‍યક્ત કરી છે.

•   કચ્‍છના જબરદાન ગઢવીને કાયદેસર પોતે જે માહિતી મેળવવા અધિકૃત છે તે માહિતી નહીં મળતાં અને નીચેથી ઉપર સુધી રજૂઆતોનું   પરિણામ પણ નહીં મળતાં આત્‍મવિલોપન.
•   મોટા ઉદ્યોગપતિઓ માટે સરકાર વાયબ્રન્‍ટ છે, પરંતુ ગુજરાતના સામાન્‍ય વ્‍યકિતનો અવાજ પણ સંભળાતો નથી.
•   જે સરકાર મુઠ્ઠીભર ઉદ્યોગપતિઓ માટે સતત દોડતી રહે છે તે સરકારની જ આમ આદમી માટેની ઉપેક્ષાના કારણે ગુજરાતના આમ આદમીએ આત્‍મવિલોપન કરવું પડે છે.

કચ્‍છ જિલ્‍લામાં આજે મામલતદાર ઓફિસમાં જ સરકારી તંત્રના અન્‍યાય સામે શ્રી જબરદાન ગઢવીને આત્‍મવિલોપન કરવાની ફરજ પડી હતી. ન્‍યાય મેળવવા માટે સતત લડી રહેલાં આમ ગુજરાતીએ ન્‍યાય માટે આત્‍મવિલોપન કરવું પડે તે હદ સુધી ગુજરાતની સરકાર અને ગુજરાતનું તંત્ર ઉંઘતું રહે તે સ્‍વર્ણિમ ગુજરાતના વર્ષમાં શરમજનક ઘટના છે. વિરોધપક્ષના નેતાશ્રી શક્તિસિંહ ગોહિલે જણાવ્‍યું હતું કે, માનીતા ઉદ્યોગપતિઓને વાયબ્રન્‍ટ ગુજરાતના નામે મફતમાં કિંમતી જમીનો ગણત્રીના દિવસોમાં જ આપી દે છે, પરંતુ ગુજરાતનો આમ આદમી પોતાની જમીન અંગેની માહિતી મેળવવા કાયદાથી અધિકૃત હોવા છતાં સતત રઝળ્યા કરે અને ગુજરાતના મુખ્‍યમંત્રીશ્રી સુધી તેણે કરેલી રજૂઆતોનું કોઇ પરિણામ ન આવે ત્‍યારે હતાશ થઇને આત્‍મવિલોપન સુધીનું પગલું ભરવું પડે તે શરમજનક ઘટના છે. ગુજરાતના આમ આદમીની ચિંતા સરકાર અને સરકારી તંત્રએ કરવી જોઇએ અને કોઇપણ ગુજરાતીને પોતાના પ્રશ્‍ન માટે આત્‍મવિલોપન સુધીના તબક્કે જવું પડે ત્‍યાં સુધી સરકાર કે સરકારી તંત્ર સંવેદનાવિ‍હિન બની જાય તે સ્‍વર્ણિમ ગુજરાતના વર્ષમાં શરમજનક છે. સ્‍વ. જબરદાન ગઢવી પોતાની વારસાઇ જમીનની માહિતી મેળવવા માટે અને આર.ટી.આઇ.ના કાયદા મુજબના પોતાના અધિકારથી લડી રહ્યા હતાં ત્‍યારે તેમને ન્‍યાય આપવામાં આવ્‍યો નહીં. પોતાને થતાં અન્‍યાય સામે સરકારના સર્વોપરી વ્‍યકિતઓ સુધી રજુઆતો થાય અને તેમ છતાં ગુજરાતના આમ આદમીનો અવાજ ન સંભળાય તે નિંદનીય છે.

• Injustice by Gujarat government drives common man of to self immolation. 
• Jabardaan Gadhvi of Kutch immolated himself after several attempts to get just a piece of information. He was entitled legally and their was no response despite representations from bottom to top.
• The government is vibrant for big industrialists but is still silent for common man.
• The government which runs after handful of industrialists neglects the common man to an extent that he if forced to immolate himself.

Jabardaan Gadhvi was forced for immolate self outside a mamlatdar office in Kutch district against injustice by the state government. It is the most shameful incident of Swarnim year when the state government and its administration are sleeping until a common man fighting for justice has to self immolate.

Condemning the incident Leader of opposition Shaktisinh Gohil said that industrialists were given valuable land at cheap rates in the name of Vibrant Gujarat but a common man has to give up his life when he does not get details of his land for which he is entitled legally. He had made representations upto Chief Minister but to no avail and dejected he killed himself. The government and administration should think about the common man and it is very shameful that in the golden year such an incident has happened when a man has to kill himself for his problems. It is sad that the government and machinery have become so insensitive.

Shri Gadhvi wanted information about his ancestral land and was fighting for his rights lawfully under the RTI act but he was denied justice. It is condemnable that despite representations to the highest authority against injustice the voice of common man goes unheard.

• Congress Legislature Party has helped Gujarat save Rs 27.5 lakh to beat global recession.
• Congress MLA’s of Gujarat responded to the appeal of Congress President Smt. Sonia Gandhi and helped Gujarat treasury save Rs 27, 55,064 during last year alone.
• Elected representatives should not go for extravaganza. Congress   party has really proved it in action.

Congress President Smt Sonia Gandhi had appealed to Congress MP’s and MLA’s to have a voluntary cut in their salaries to help the nation at the time of global recession. Consequently Congress MLA’s in Gujarat decided to go for voluntary cut in their salary.

This decision helped Gujarat treasury save Rs 27,55,064 during last year alone. Congress MLA’s have responded positively by taking action instead of just talking about it. Congress members stay away from extravaganza and executive and business class air travel, following the advice of their leader Smt Sonia Gandhi.
