• ગુજરાતની કોઇ દરખાસ્‍ત ન હોવા છતાં કેન્‍દ્ર સરકારે પ્રવાસન ક્ષેત્રે રુ. ૧પ૦ કરોડ રુપિ‍યા ફાળવવાની જાહેરાત કરી.
• કબીરવડ ખાતે મેગા સરકીટના રુ. ૪૮૦૯ લાખના પ્રોજેકટનું ખાતમુર્હુત.
• માન. શ્રી અહેમદભાઇ પટેલના આગ્રહથી કબીરવડ, દ્વારકા અને પોરબંદરના પ્રવાસનના કામો કરોડોના ખર્ચે થશે.

             કેન્‍દ્ર સરકારે ગુજરાત માટે પ્રવાસ ક્ષેત્રે ૧પ૦ કરોડ રુપિ‍યા આપવાની જાહેરાત કરી. કેન્‍દ્ર સરકારના પ્રવાસન મંત્રીશ્રી સુબોધકાંત સહાયે આજે કબીરવડ ખાતે ઇન્‍ટ્રીગ્રેટેડ ટુરીઝમ ડેવલપમેન્‍ટ ઓફ મેગા સરકીટ ”શુકલતીર્થ, મંગલેશ્વર, કબીરવડ અને અંગારેશ્વર”નું ખાતમુર્હુત કરતાં કબીરવડ ખાતે જણાવ્‍યું હતું કે, રાષ્‍ટ્રીય નેતાશ્રી અહેમદભાઇ પટેલના આગ્રહના કારણે કબીરવડ ખાતેની મેગા વિકાસ યોજના માટે રુ. ૪૮૦૯ લાખનો પ્રોજેક્ટ મંજૂર કરવામાં આવ્‍યો છે.માન. શ્રી સુબોધકાંત સહાયે પોતાના પ્રવચનમાં જણાવ્‍યું હતું કે, કેન્‍દ્ર સરકાર ગુજરાતને પ્રવાસન ક્ષેત્રે ધમધમતું બનાવવા પૂરતો સહયોગ આપવા માંગે છે. રાજ્ય સરકારની કબીરવડની મેગા સરકીટ માટે કોઇ દરખાસ્‍ત ન હતી તેમ છતાં માન. શ્રી અહેમદભાઇ પટેલના આગ્રહના કારણે કબીરવડ ખાતેની મેગા સરકીટ, પોરબંદર મહાત્‍મા ગાંધીજીના જન્‍મસ્‍થાન અને અન્‍ય પૂજ્ય બાપુના સંસ્‍મરણોના સાથે સ્‍થળોની મેગા સરકીટ તેમજ દ્વારકા ખાતેની મેગા સરકીટ એમ આ ત્રણ પ્રોજેક્ટમાં ૧પ૦ કરોડ રુપિ‍યા કેન્‍દ્ર સરકાર ગુજરાતને આપશે. આ ઉપરાંત, અન્‍ય પ્રોજેક્ટો માટે કેન્‍દ્ર સરકારે ગયા વર્ષે ૮૦ કરોડ રુપિ‍યા ફાળવેલાં છે. આગામી વર્ષના આયોજનમાં પણ કેન્‍દ્ર સરકાર વિવિધ યોજનાઓ માટે ગુજરાતને નાણાં ફાળવશે.

        ગુજરાતના મહત્‍વના આ યાત્રા અને પ્રવાસનના ધામોની ચિંતા કેન્‍દ્ર સરકારે સેવીને ખાસ યોજનાઓ મંજૂર કરી છે, તે માટે વિરોધપક્ષના નેતાશ્રી શક્તિસિંહ ગોહિલે કેન્‍દ્ર સરકારના મંત્રીશ્રી સુબોધકાંત સહાય તથા માન. શ્રી અહેમદભાઇ પટેલનો આભાર માન્યો હતો. રાજીવ ગાંધી વિદ્યુતીકરણ યોજના નીચે ગુજરાત સરકારને કેન્‍દ્ર સરકારે ૧૦૦૦ કરોડ રુપિ‍યા ફાળવેલાં છે, જેનાથી ગ્રામીણ વિસ્‍તારોમાં સતત વિજ પ્રવાહ આપી શકાય છે. કબીરવડને પણ આ યોજના નીચે રાજય સરકાર તાત્‍કાલિક જોડી આપે અને ર૪ ક્લાક વિજ પ્રવાહ અવિરત મળે તેવી વ્‍યવસ્‍થા કરવા શ્રી ગોહિલે માંગણી કરી છે.

        કબીરવડ ખાતેના મેગા સરકીટના શ્રી સુબોધકાંત સહાયજીના હસ્‍તેના ખાતમૂર્હત કાર્યક્રમમાં રાજ્ય સરકારના પ્રવાસન મંત્રીશ્રી જયનારાયણ વ્‍યાસ, વિરોધપક્ષના નેતાશ્રી શક્તિસિંહ ગોહિલ, રાજ્ય મંત્રીશ્રી જીતેન્‍દ્રભાઇ સુખડીયા, શ્રી કમલેશભાઇ પટેલ, કોંગ્રેસપક્ષના દંડક શ્રી ઇકબાલભાઇ પટેલ, ધારાસભ્‍યશ્રી કિરણભાઇ મકવાણા તેમજ અનેક આગેવાનો ઉપસ્થિત રહ્યાં હતાં.

• ગોધરા ખાતે મુખ્‍યમંત્રીશ્રીએ આદિવાસી મહિલા સંસદસભ્‍ય પર અત્‍યાચાર કરાવ્‍યો.
• મુખ્‍યમંત્રીશ્રીના ઇશારે કોંગ્રેસના સંસદસભ્‍ય ડો.પ્રભાબેન તાવિયાડને ઢસડીને સ્‍ટેજ પરથી દૂર કરાયાં.
• કોંગ્રેસના ધારાસભ્‍યશ્રીઓ અને કાર્યકર્તાઓને મુખ્‍યમંત્રીશ્રી પાસે રજૂઆત કરવા જતાં પોલીસે જુલમ કરી એરેસ્‍ટ કર્યા.
• મુખ્‍યમંત્રીશ્રીમાં હિંમત હોય તો ભાજપના નામે રાજકીય કાર્યક્રમ કરે.
• મુખ્‍યમંત્રીશ્રી પ્રજાના પૈસે સરકારી કાર્યક્રમોને રાજકીય કાર્યક્રમ બનાવવાનું બંધ કરે.

 મુખ્‍યમંત્રીશ્રીની હાજરીમાં સરકારી કાર્યક્રમના મંચ પર એક આદિવાસી મહિલા ચૂંટાયેલા સંસદસભ્‍યશ્રી પર બેફામ અત્‍યાચાર કરી તેમને ઢસડીને દૂર કરવામાં આવ્‍યા તે સમગ્ર મહિલા સમાજનું અપમાન છે. ગુજરાત રાજયના મુખ્‍યમંત્રીશ્રીએ પ્રજાના પૈસે પોતાની પ્રસિધ્‍ધી માટેનો કૃષિ‍ મહોત્‍સવના નામે ગોધરા ખાતે આજે તાયફો યોજેલો હતો. આ કાર્યક્રમ દરમ્‍યાન સંસદસભ્‍ય ડો.પ્રભાબેન તાવિયાડને નિમંત્રણ આપવામાં આવેલું હતું. ડો.પ્રભાબેન તાવિયાડે કોંગ્રેસના ચૂંટાયેલા ધારાસભ્‍યશ્રીઓને પોલીસ સરકારી સમારંભમાં નહીં આવવા દેવા માટે એરેસ્‍ટ કરે છે અને સરકારી સમારંભમાં ભાજપના હોદ્દેદારોને મંચ આપવામાં આવે છે તે વ્‍યાજબી નથી એવી રજૂઆત કરતાંની સાથે મુખ્‍યમંત્રીશ્રીના ઇશારે કોંગ્રેસના ચૂંટાયેલા મહિલા આદિવાસી સંસદસભ્‍યશ્રીને ઢસડીને તેમના પર અત્‍યાચાર કરી જાહેર સરકારી કાર્યક્રમના સ્‍થળેથી પોલીસ પકડીને સરકીટ હાઉસ મૂકી આવી હતી. મુખ્‍યમંત્રીશ્રીએ એક આદિવાસી ચૂંટાયેલ મહિલા પર કરાવેલાં અત્યાચારથી સમગ્ર ગુજરાતની મહિલાઓ અને આદિવાસી સમાજનું અપમાન થયેલ છે. ગુજરાત વિધાનસભા વિરોધપક્ષના નેતાશ્રી શક્તિસિંહ ગોહિલે મુખ્‍યમંત્રીશ્રીના આ વર્તાવ બદલ તેઓએ ગુજરાતની મહિલાઓ અને આદિવાસી સમાજની માફી માગવી જોઇએ તેવી માંગણી કરી છે.

આજે ગોધરા ખાતે મુખ્‍યમંત્રીશ્રી સરકારી કાર્યક્રમ કૃષિ‍ મહોત્‍સવનો યોજેલો હતો તેમાં જવાના હતાં. મુખ્‍યમંત્રીશ્રીના આગમન સમયે કોંગ્રેસપક્ષના ધારાસભ્‍યશ્રીઓ શ્રી સી.કે.રાઉલજી, શ્રી હીરાભાઇ પટેલ, જિલ્‍લા કોંગ્રેસના પ્રમુખશ્રી પી.એમ.પટેલ તથા આગેવાનો ગોધરાની પી.ડી.સી.બેન્‍ક ચાલુ કરવા બાબતે તેમજ જિલ્‍લાના અનેક પ્રશ્નો માટે મુખ્‍યમંત્રીશ્રીને રજૂઆત કરવા જવાના હતાં. આ આગેવાનોનો લોકશાહી રીતે મુખ્‍યમંત્રીશ્રીને મળવાનો અધિકાર હતો આમ છતાં ગુજરાતના મુખ્‍યમંત્રીશ્રીએ સત્તાના જોરે ચૂંટાયેલા ધારાસભ્‍યશ્રીઓ અને કોંગ્રેસના  કાર્યકર્તાઓને પોલીસના દમનથી પકડીને પૂરી ‍દીધા હતાં. આ બાબતની કાર્યક્રમના સ્‍થળે સંસદસભ્‍યશ્રી ડો.પ્રભાબેન તાવિયાડ રજૂઆત કરવા જતાં મુખ્‍યમંત્રીશ્રીએ કૌરવોના ઇતિહાસની જેમ એક મહિલા ઉપર અત્‍યાચાર કરાવવાનું પાપ કરીને ગુજરાતનીતમામ મહિલાઓ તથા આદિવાસી જનતાનું અપમાન કરેલ છે.

        ખેડૂતોના હિત માટે વાપરવાના નાણાં મુખ્‍યમંત્રીશ્રી પોતાના રાજકીય લાભ તથા અહમના પોષણ માટે સમારંભો પાછળ કૃષિ‍ મહોત્‍સવના નામે બેફામ વેડફી રહ્યાં છે. સરકારી સમારંભોમાં ચૂંટાયેલા સભ્‍યોને યોગ્‍ય સ્‍થાન અને રજૂઆતની તક આપવાના બદલે કોંગ્રેસપક્ષના ધારાસભ્‍યશ્રીઓને એરેસ્‍ટ કરાવવાનું પાપ મુખ્‍યમંત્રી કરે છે. કોઇપણ રાજકીય પક્ષના હોદ્દેદારને સરકારી સમારંભમાં સ્‍થાન ન મળે તેવી પ્રથા હોવા છતાં ભાજપના રાજકીય કાર્યકર્તાઓ સરકારી સમારંભોને પક્ષનો કાર્યક્રમ બનાવે છે.

        ગુજરાતના મુખ્‍યમંત્રીશ્રીમાં તાકાત અને હિંમત હોય તો ભાજપના નામે સમારંભોનું આયોજન કરે પરંતુ પ્રજાના પૈસા રાજકીય કાર્યક્રમો તરીકે સરકારી કાર્યક્રમોમાં વેડફવાનું બંધ કરે.

• Tribal woman Congress MP brutally treated at the instance of Chief Minister at Godhra.
• Woman MP Dr. Prabhaben Taviad was dragged on the stage by police under instructions from Chief Minister.
• Police treated brutally and arrested Congress MLAs and other leaders when they tried to submit a representation to Chief Minister.
• If CM has guts then he should hold political programmes under the banner of BJP.
• Chief Minister should stop using public money at politically motivated government function.

Leader of Opposition Shaktisinh Gohil today condemned Gujarat Chief Minister for the inhuman treatment of Congress woman MP Prabha Taviad at a public function at Godhra presided by Chief Minister himself. He said that Prabhaben Taviad who was invited to the function as local MP was dragged on the stage and removed from there. Chief Minister was angry over her because she had tried to protest against the brutal treatment of Congress MLAs and other leaders who wanted to draw the attention of the Chief Minister to some local problems, he said. Chief Minister should apologize to women and tribal people for the public humiliation of elected woman tribal representative, Gohil demanded.

Giving details of the incident, Gohil said that Prabhaben was invited to a public function organized at Godhra for the personal publicity of Chief Minister under the banner of Krishi Mahotsav. Some Congress MLAs and other leaders were badly treated and arrested by police when they tried to draw the attention of the Chief Minister to some local problems.

As a senior Congress leader present there Prabhaben tried to take up the matter with the Chief Minister. Instead of interacting with the local MP, Chief Minister saw that she was dragged away from the stage. She was detained by police who took her to circuit house.

He said that Congress MLAs C. K. Raoulji, Hirabhai Patel, District Congress President P. M. Patel and other leaders wanted to draw the attention of the CM to the reopening of PDC bank and other local issues.

Gohil said that the Chief Minister was squandering public money for personal publicity through government programmes like Krishi Mahotsav. Local elected congress representatives were arrested while office bearers of BJP were given prominent place in government functions.

Gohil challenged the Chief Minister to hold political programmes under the banner of BJP and requested him not to waste public money for the gratification of his ego.

• Gujarat government should give relief reducing tax burden.
• In Gujarat petrol can be cheaper by ` 14 a liter and diesel ` 12 if Gujarat government reduces its taxes.
• Though the rate of crude oil was much low when BJP was in power, there was increase of prices of petrol and diesel 17 times.
• Other states have eight percent tax on petrol and diesel while Gujarat has 14 percent. This leads to burden of ` 8,120 crore on people of Gujarat.
• Congress government in Delhi has given subsidy of ` 40 per cylinder. Gujarat should follow it.
• States like Haryana and West Bengal have given relief to people by reducing tax. Gujarat should also do the same.
• The price of crude oil was 68 dollar a barrel. It is now 110 dollar which has forced increase in price.

Leader of Opposition Shaktisinh Gohil today suggested that Gujarat government should reduce taxes on petrol and diesel to provide relief to people instead of indulging in politically motivated statements.

Interacting with media, Gohil pointed out that there was VAT of 23 percent on petrol with additional tax of two percent and VAT of 21 percent on diesel with additional tax of three percent. In Gujarat petrol can be cheaper by ` 14 a liter and diesel ` 12 if Gujarat government reduces its taxes, he said.

Gujarat government is taking benefit of VAT. It should at least give relief on increased prices. Defending increase in the price, Gohil said that the price of crude oil which was 68 dollar a barrel is now 110 dollar which has forced increase in price. He said that it was NDA which had linked prices with international prices.

Giving examples of the measures taken by other states, he said that Congress government in Delhi has given subsidy of ` 40 per cylinder. States like Haryana and West Bengal have given relief to people by reducing tax. Gujarat should also do the same instead of making hue and cry over the issue.

Demanding a special VAT rate structure for petrol and diesel, he said that Gujarat consumes 250 crore liters of petrol and 330 crore liters of diesel every year. Other states have eight percent tax on petrol and diesel while Gujarat has 14 percent. This leads to burden of ` 8,120 crore on people of Gujarat. Gujarat can reduce the burden ranging from ` 8 to ` 12 a liter.

Attacking the BJP, he said that during its six year rule NDA had increased prices of petroleum products 17 times and there was a steep rise in the price of kerosene. He said that the Congress government, on the other hand given substantial subsidy in kerosene and diesel. In the price of LPG the increase is not as much done by the NDA. He gave details of price increase by NDA and UPA to drive home his point.

WB has reduced tax on diesel from ` 17 to ` 12.5 a liter while there is reduction in tax on petrol also. Bihar where there was BJP coalition government, prices were reduced with tax reduction by state government. In Gujarat no relief has been given.

Gohil demanded that Gujarat should bring down the tax rate to the level to other states and give immediate relief to people of Gujarat.

• ગુજરાતમાં પેટ્રોલ અને ડિઝલ પર ટેક્ષનું ભારણ સૌથી વધારે છે.
• ગુજરાત સરકાર ગુજરાતની જનતાને ટેક્ષના ભારણમાં ઘટાડો કરી રાહત આપે.
• ગુજરાતમાં પેટ્રોલ ૧૪ અને ડિઝલ ૧ર જેટલું સસ્‍તુ થઇ શકે તેમ છે.
• કેન્‍દ્રમાં ભાજપની સરકાર હતી ત્‍યારે કાચા ક્રૂડની કિંમત આજની સરખામણીએ ઘણીજ નીચી હોવા છતાં ૧૭ વખત પેટ્રોલ અને ડિઝલના ભાવ વધારવામાં આવ્‍યા હતાં.
• અન્‍ય રાજ્યોમાં પેટ્રોલ અને ડિઝલ પર ૮ ટકા કર છે ત્‍યારે ગુજરાત ૧૪ ટકા કરતાં વધારે કર લે છે અને તેથી પેટ્રોલ અને ડિઝલના રુ.૮,૧ર૦ કરોડ જનતાએ વધુ ચૂકવવા પડે છે.
• દિલ્‍હીની કોંગ્રેસની સરકારે ગેસના સિલીન્‍ડર પર ૪૦ રુપિ‍યા સબસીડી આપી છે. તેજ રીતે ગુજરાત પણ સબસીડી આપે.
• હરિયાણા અને પશ્ચિમ બંગાળ જેવા રાજ્યોએ પેટ્રોલિયમ પેદાશ પરના ટેક્ષ ઘટાડીને જનતાને રાહત આપી છે. તેજ રીતે ગુજરાત પણ રાહત આપે.
• કાચા ક્રૂડની કિંમત પ્રતિ બેરલે ૬૮ ડોલર હતી તે આજે વધીને ૧૧૦ ડોલર કરતાં વધારે થતાં ન છૂટકે પેટ્રોલના ભાવમાં વધારો.

કેન્‍દ્ર સરકાર સામે પેટ્રોલના ભાવ વધારા અંગે રાજકીય નિવેદનો અને કાદવ ઉછાળવાના બદલે ગુજરાતની ભાજપની સરકાર પેટ્રોલ અને ડિઝલ પરના વેટના દરમાં ઘટાડો કરે. દેશમાં સૌથી વધારે પેટ્રોલ અને ડિઝલ પર વેલ્‍યુએડેડ ટેક્ષ (વેટ)ગુજરાતમાં લેવામાં આવે છે. ગુજરાતમાં પેટ્રોલ પર ર૩ ટકાનો વેટ ઉપરાંત ર ટકાનો વધારાનો ટેક્ષ ગુજરાત સરકાર લઇ રહી છે.  ડિઝલ ઉપર ગુજરાતની સરકાર ર૧ ટકા વેટ અને ૩ ટકા વધારાનો સરચાર્જ લઇ રહી છે. જો ગુજરાત સરકારનો ટેક્ષ પેટ્રોલ અને ડિઝલ ઉપર નાબૂદ કરવામાં આવે  તો પેટ્રોલ ૧૪ રુપિ‍યા જેટલું અને ડિઝલ ૧ર રુપિ‍યા જેટલું સસ્‍તુ થઇ શકે છે. ભાવ વધારાના કારણે ગુજરાતની સરકાર વેટના દરોનો સીધો લાભ મેળવી રહી છે. કમસેકમ વધેલી કિંમત ઉપરથી તો વેટનો દર દૂર કરવો જ જોઇએ. આંતરાષ્‍ટ્રીય બજારમાં કાચા ક્રૂડની કિંમત બેરલના ૬૮ ડોલર હતાં તે વધીને ૧૧૦ ડોલરની સપાટીએ પહોંચ્‍યા પછી ન છૂટકે પેટો્લ ઉપર ભાવ વધારો કરવામાં આવ્‍યો છે. પેટ્રોલ અને ડિઝલને નિયંત્રણમુક્ત કરીને આંતરાષ્‍ટ્રીય બજારમાં ભાવો વધે તેની સાથે કંપનીઓને ભાવ વધારો કરવાની છૂટ આપવાની નીતિ ભાજપની આગેવાનીવાળી એન.ડી.એ.ની સરકારે જ ઘડી હતી. પેટ્રોલિયમ પેદાશોમાં ભાવ વધારો થતાં હરિયાણાના મુખ્‍યમંત્રીશ્રીએ વેટના દરોમાં ખાસ રાહતો આપી હતી. દિલ્‍હીની કોંગ્રેસની સરકારે ગેસના સીલીન્‍ડર ઉપર ૪૦ રુપિ‍યાની ખાસ સબસીડી જાહેર કરી હતી. મોંઘવારીના નામે રો કકળ કરનારી ભાજપની કોઇપણ સરકારે રાહત આપી નથી. ગુજરાત વિધાનસભા વિરોધક્ષપના નેતાશ્રી શક્તિસિંહ ગોહિલે માંગણી કરી હતી કે, ગુજરાતની સરકાર વેટના દરોમાં ખાસ રાહતો જાહેર કરે જેથી કરીને ગુજરાતની જનતા ઉપર મોંઘવારીમાં આવેલાં વધારામાં રાહત મળી શકે. ગુજરાતમાં પેટ્રોલ વાર્ષિ‍ક રપ૦ કરોડ લીટર અને ડિઝલ વાર્ષિ‍ક ૩૩૦ કરોડ લીટર વપરાય છે. ગુજરાતની પ્રજા ઉપર અન્‍ય રાજ્યોના ૮ ટકાના ટેક્ષની સરખામણીએ ગુજરાત સરકાર ૧૪ ટકા  વધારાનો કર લઇ રહી છે અને તેની જો ગણતરી કરીએ તો ગુજરાતની જનતા પાસેથી ભાજપની સરકાર દર વર્ષે ૮૧ર૦ કરોડ રુપિ‍યા વધારે લઇ રહી છે. અન્‍ય રાજ્યોના કર માળખાની સાથે પેટ્રોલ ડિઝલ અને ગેસમાં રાહતો ગુજરાતની સરકાર આપે તો પેટ્રોલ અને ડિઝલમાં ૮ થી ૧ર રુપિ‍યા સુધીની રાહતો અપાઇ શકે તેમ છે. દિલ્‍હીની માફક ગેસના સીલીન્‍ડર પર ૪૦ રુપિ‍યાની સબસીડી પણ ગુજરાત સરકારે આપવી જોઇએ.

કેન્‍દ્રમાં ભાજપની આગેવાનીવાળી એન.ડી.એ.સરકારના શાસનકાળ દરમ્‍યાનમાં છ વર્ષમાં ૧૭ વખત પેટ્રોલ અને ડિઝલનો ભાવ વધારો કરવામાં આવ્‍યો હતો. ગરીબ વ્‍યક્તિ જે કેરોસીનનો ઉપયોગ કરે છે તે કેરોસીનના ભાવમાં પણ ભૂતકાળમાં ક્યારેય વધારો ન થયો હોય તેટલો વધારો ભાજપની આગેવાનીવાળી એન.ડી.એ.ની સરકારે કરેલો હતો. કાચા ક્રૂડની કિંમતમાં ધરખમ વધારો થયા છતાં યુ.પી.એ.ની.સરકારે સબસીડી આપીને કેરોસીન તથા ડિઝલમાં તેમજ પેટ્રોલમાં રાહતો આપી છે. રાંધણગેસના ભાવોમાં ભાજપની સરકારે વધારા કર્યા હતાં પરંતુ કોંગ્રેસની આગેવાનીવાળી કેન્‍દ્ર સરકારે રાંધણ ગેસના ભાવોમાં એન.ડી.એ.ની સરકારની જેમ ભાવ વધારો કર્યો નથી. કેન્‍દ્રમાં ભાજપની આગેવાનીવાળી એન.ડી.એ.ની સરકારમાં પેટ્રોલિયમ પેદાશોમાં થયેલાં ભાવ વધારાનું કોષ્‍ટક તથા કેન્‍દ્રમાં આવેલી પ્રથમ પાંચ વર્ષની યુ.પી.એ.ની સરકારનું પેટ્રોલના ભાવમાં વધારો તેમજ પાંચ વખતનો થયેલો ઘટાડો દર્શાવતું કોષ્‍ટક નીચે મૂકેલું છે જે સત્‍ય હકીકત દર્શાવે છે.

પશ્ચિમ બંગાળમાં ડિઝલ ઉપર ૧૭ ટકા વેરો હતો તે ઘટાડીને ૧ર.પ ટકા કરવામાં આવ્‍યો છે. પેટો્લ પરનો ટેક્ષ પણ બંગાળમાં ઘટાડવામાં આવ્‍યો છે. બિહારમાં કે જયાં ભાજપ અને જનતાદળની સરકાર છે તેણે પણ ભૂતકાળમાં પેટ્રોલિયમ પેદશો પરના કરના માળખામાં ઘટાડો કર્યો હતો. પરંતુ ગુજરાતની ભાજપની સરકારે કોઇપણ જાતનો ઘટાડો કર્યો નથી. કેન્‍દ્રમાં જયારે એન.ડી.એ.ની સરકાર હતી ત્‍યારે કાચા ક્રૂડની કિંમત એક બેરલની માત્ર ૩પ કે ૪૦ ડોલર હતી જયારે અત્‍યારે આંતરરાષ્‍ટ્રીય બજારોમાં કાચા ક્રૂડની કિંમત ત્રણ ગણા કરતાં પણ વધારે વધી ગઇ છે.

          આંતરરાષ્‍ટ્રીય બજારમાં કાચા ક્રૂડની કિંમત વધવાથી પેટ્રોલ અને ડિઝલના જે ભાવ વધે છે તેના કારણે રાજ્ય સરકારના અતિશય  વધારે ટેક્ષના ભારણના કારણે ગુજરાતની જનતા ઉપર બિન જરુરી વધારાનો માર પડે છે. ગત વર્ષના ગુજરાતની પેટ્રોલિયમ પેદાશો પરની વેટની આવકના આંકડાઓ જોઇએ તો સ્‍પષ્‍ટ થાય છે કે,કરોડો રુપિ‍યાનો કરબોજ ગુજરાતની જનતા પર ભાજપની સરકારના ઉંચા કરબોજ અને રાહત નહીં આપવાની નીતિના કારણે પડેલ છે. કોંગ્રેસપક્ષ માંગણી કરે છે કે, ગુજરાતની સરકાર અન્‍ય રાજ્યોની સરખામણીમાં પેટ્રોલ અને ડિઝલ પરના વેટના દર નીચા લાવે તેમજ વધેલી કિંમત પરથી ટેક્ષનું ભારણ દૂર કરે જેથી લોકોને પેટ્રોલ અને ડિઝલમાં મોંઘવારીનો માર ઓછો થાય.

• BJP has got only five of the 824 seats in the five states.
• BJP which claimed to have great impact in the elections of five states is completely wiped out.
• BJP candidates defeated wherever Gujarat CM campaigned in elections.
• People rejected vicious campaign of BJP against Congress.

Election results of five states show that people have rejected BJP and its policies as party has managed to get only five of the 824 seats for which elections were held. The results have also exposed hollowness of the star campaigner of BJP, Chief Minister of Gujarat. BJP candidates for whom Gujarat Chief Minister campaigned have been defeated. In his studied reactions to the results of elections in the five states, Leader of Opposition in Gujarat Assembly, Shaktisinh Gohil said that Gujarat Chief Minister who is trying to pose himself as a national leader was shown a place by the electorate. Referring to Modi’s tendency of rhetoric, he said that it has even led to the defeat of state BJP president in Assam.

People of these states have also realized double speak of BJP on the issue of corruption. He said that Congress has promptly taken action against its leaders or associates involved in corruption. BJP, on the other hand, talks about campaign against corruption, but always defends its own leaders when they face corruption charges. Whether it be Karnataka Chief Minister or Chief Minister of Gujarat, Gohil said.

People of these states have endorsed the leadership of Prime Minister Manmohan Singh and Sonia Gandhi and have welcomed the commitment of Rahul Gandhi for national development.

Except Tamilnadu where people were against the associate party, people have reposed faith in Congress in all states by bringing the Congress and its coalition to power. Assam presents an interesting case study, he said. Gujarat Chief Minister had a vigorous campaign here and BJP had claimed to come in power. The results show that it has got a humiliating defeat with only three seats to show its existence. Similarly, he said that much before elections, Jaylalita who has a sweeping victory in Tamilnadu, had offered support of her party to Congress. It is obvious that Jaylalita has got vote for people’s opposition to DMK.

             દેશમાં યોજાયેલી પાંચ રાજ્યોની ચૂંટણીઓમાં દેશના મુખ્‍ય વિરોધપક્ષ ગણાતાં ભાજપને કુલ ૮ર૪માંથી માત્ર પ બેઠકો મળેલી છે. ગુજરાત વિધાનસભા વિરોધપક્ષના નેતાશ્રી શક્તિસિંહ ગોહિલે પાંચ રાજ્યોની ચૂંટણીના પરિણામો પર પ્રતિક્રિયા આપતાં જણાવ્‍યું હતું કે, ભાજપના જુઠ્ઠાણાઓને દેશના પાંચ રાજયોની જનતાએ જાકારો આપ્‍યો છે. ગુજરાતના મુખ્‍યમંત્રીશ્રી રાષ્‍ટ્રીય નેતા બનવાના પોતાના સ્‍વપ્‍નાઓ લઇને પાંચ રાજ્યોમાં ભાજપના મુખ્‍ય સ્‍ટાર પ્રચારક તરીકે સભાઓ કરવા ગયા હતાં, પરંતુ તેઓએ જ્યાં જ્યાં સભાઓ કરી છે ત્‍યાં ત્‍યાં ભાજપના ઉમેદવારોનો પરાજય થયો છે. આસામમાં ગુજરાતના મુખ્‍યમંત્રીશ્રીએ બેફામ વાણીવિલાસ કરવાના કારણે આસામના પ્રદેશ ભાજપના પ્રમુખ હારી ગયા છે. કોંગ્રેસપક્ષ વિરુધ્‍ધ બેફામ આક્ષેપો અને નીચલી કક્ષાની ભાષાનો પ્રયોગ કરનારા ભાજપને મતદારોએ સાથ આપ્‍યો નથી.

        ભ્રષ્‍ટાચાર સામે ઝૂંબેશની વાત કરનારા ભાજપના બેવડા ધોરણોને પાંચ રાજ્યોની જનતા ઓળખી ચૂકી છે. કોંગ્રેસપક્ષે પોતાના પક્ષના કે પોતાના સાથી પક્ષના કોઇપણ મોટા નેતા સામે ભ્રષ્‍ટાચારનો સહેજ પણ આક્ષેપ આવ્‍યો તો તેમને નૈતિકતાના ધોરણે પદ પરથી દૂર કર્યા છે તેમજ ભ્રષ્‍ટાચારના આક્ષેપવાળા કોઇને પણ બચાવવા માટે કોંગ્રેસપક્ષ તરફથી ક્યારેય પ્રયત્‍ન થયો નથી. ભાજપના કર્ણાટકના મુખ્‍યપ્રધાન હોય કે ગુજરાતમાં ચાલતો ભ્રષ્‍ટાચાર હોય,
ભાજપ દ્વારા હંમેશા પોતાના ભ્રષ્‍ટાચારી નેતાઓને બચાવવાનો પ્રયત્‍ન થયો છે. જેને પાંચ રાજ્યોની જનતા બરોબર ઓળખી ચૂકી છે.

        પાંચ રાજ્યોની જનતાએ શ્રીમતી સોનિયા ગાંધી તથા ડો. મનમોહનસિંઘના સફળ નેતૃત્‍વ અને શ્રી રાહુલ ગાંધીના રાષ્‍ટ્રીય વિકાસ માટેના સનિષ્‍ઠ પ્રયત્નોને સહયોગ આપ્‍યો છે.

        તામિલનાડુમાં સાથી પક્ષોની સામેના વિરુધ્‍ધને બાદ કરતાં બાકીના તમામ રાજ્યોમાં કોંગ્રેસપક્ષ અને કોંગ્રેસપક્ષના સાથી પક્ષોને મતદાતાઓએ જબરજસ્‍ત સહયોગ આપેલો છે. કેરાલામાં કોંગ્રેસના યુ.ડી.એસ. જોડાણને ૩૧ સીટોનો ફાયદો થયો છે. વેસ્‍ટ બંગાળમાં ટી.એમ.સી. સાથેના કોંગ્રેસના જોડાણવાળા એલાયન્‍સને ૧૭૧ બેઠકોનો ફાયદો થયો છે. આસામમાં કોંગ્રેસને રપ બેઠકોનો ફાયદો થયો છે. જે બતાવે છે કે, દેશની જનતાને કોંગ્રેસપક્ષમાં વિશ્વાસ છે.

        આસામમાં ચૂંટણી પ્રચારનો ભાજપ માટે દોર સંભાળનારા ગુજરાતના મુખ્‍યમંત્રીશ્રીને આસામની જનતાએ રીજેક્ટ કર્યા છે અને આસામમાં સરકાર બનવાનો દાવો કરનારી ભારતીય જનતા પાર્ટીની બેઠકોમાં ઘટાડો થયો છે અને માત્ર ત્રણ બેઠકો ભાજપને મળી છે.

        તામિલનાડુમાં ભાજપનો પડછાયો લેવાથી પણ નુકશાન જશે તેવું લાગતાં ચૂંટણી પહેલાં જયલલિતાએ કહ્યું હતું કે, જરુર પડ્યે તેઓ કેન્‍દ્રમાં કોંગ્રેસને સમર્થન આપશે. આમ, તામિલનાડુમાં પણ સત્‍તા મેળવનારા જયલલિતાના પક્ષને લોકોએ જયલલિતાની ભાજપની દૂરીના કારણે જ ડી.એમ.કે.ની વિરુધ્‍ધ મતો આપ્‍યા છે.

• ગરીબ લોકો માટેની નરેગા યોજનાના પૈસા ભા.જ.પ.ના નેતાઓ જ ખાઇ ગયાં.
• ભુજ ખાતેની કોંગ્રેસની જનસભામાં હજારોની મેદની.

             ઉદ્યોગપતિઓને માટે વાયબ્રન્‍ટ બનનારી ગુજરાતની સરકાર કચ્‍છની આમ જનતાની ઉપેક્ષા કરી રહી છે. ગુજરાત પ્રદેશ કોંગ્રેસ સમિતિના પ્રમુખશ્રી અર્જુનભાઇ મોઢવાડીયા તથા ગુજરાત વિધાનસભા વિરોધપક્ષના નેતાશ્રી શક્તિસિંહ ગોહિલે કચ્‍છની જનતાના આમ પ્રશ્નો અને મુશ્‍કેલીઓને સમજવા માટે ભુજ ખાતે કાર્યક્રમ રાખેલો હતો. કોંગ્રેસપક્ષના જન સમસ્‍યા માટેના આ કાર્યક્રમમાં સંખ્‍યાબંધ લોકોએ પોતાને પડતી મુશ્‍કેલીઓ અને સરકાર તથા તંત્ર દ્વારા ચાલતાં બેફામ ભ્રષ્‍ટાચારની રજૂઆતો કરી હતી. જે ખિસ્‍સા ભરી શકે તેમના માટે કાયદાથી વિરુધ્‍ધ જઇને ખાસ કિસ્‍સામાં મંજૂરીઓ મળે છે, પરંતુ આમ આદમીને કોઇ જ સાંભળતું નથી તેવી વ્‍યાપક ફરિયાદો પ્રાપ્‍ત થઇ હતી. કોંગ્રેસપક્ષ આયોજીત ભુજ ખાતેની જાહેરસભામાં હજારો લોકો ઉમટી પડ્યા હતાં. આ જનસભાને સંબોધતા ગુજરાત પ્રદેશ કોંગ્રેસ સમિતિના પ્રમુખશ્રી અર્જુનભાઇ મોઢવાડીયાએ જણાવ્‍યું હતું કે, મુખ્‍યમંત્રી અદાણીને લ્‍હાણી કરે છે, પરંતુ સામાન્‍ય ખેડૂતની સમસ્‍યા માટે તેમને સમય નથી. મુંદ્રા પોર્ટની અદાણીને અપાયેલી જમીનો, ભા.જ.પ.ના શ્રી વૈંકેયા નાયડુના સંપર્કવાળી આર્ચિયન કંપનીને અપાયેલી જમીનો જેવા અનેક દાખલા છે કે જેમાં કરોડો રુપિ‍યાની પ્રજાની મિલકત મફતના ભાવે આપી દેવામાં આવી છે. એક તરફ ગુજરાતની સરકાર એવો દાવો કરે છે કે, ગુજરાત પાસે સરપ્‍લસ વિજળી છે અને ગુજરાત બહાર વિજળી વેચી રહી છે, જયારે બીજી તરફ ડાર્કઝોનના નામે ખેડૂતોને વિજ જોડાણથી વંચિત રાખવામાં આવે છે. ગુજરાતના ખેડૂતોને પૂરતી વિજળી આપવામાં આવતી નથી. ડાર્કઝોનમાં ઉદ્યોગપતિને પાણી ખેંચવા માટે વિજ જોડાણ મળે પરંતુ ખેડૂતને વિજ જોડાણ ન મળે તેનાથી મોટો અન્‍યાય બીજો કોઇ હોઇ શકે નહી. ગુજરાત રાજ્યમાં મુખ્‍યમંત્રીશ્રી દ્વારા ચાલતાં કરોડો રુપિ‍યાના ભ્રષ્‍ટાચાર અને જમીનોના કૌભાંડોની સીલસીલાબંધ હકીકતો જાહેર સભામાં શ્રી અર્જુનભાઇ મોઢવાડીયાએ આપી હતી. વિરોધપક્ષના નેતાશ્રી શક્તિસિંહ ગોહિલે જાહેર સભાને સંબોધન કરતાં જણાવ્‍યુ હતું કે, કચ્‍છના સામાન્‍ય ખેડૂત જબરદાન ગઢવીને ગુજરાત સરકાર તરફથી થતા અન્‍યાય માટે આત્‍મવિલોપન કરવું પડે, ત્‍યારે બીજી તરફ કચ્‍છની ર‍ક્ષિ‍ત જંગલની ર૦૦૮ હેકટર જમીન મફતના ભાવે અદાણીને આપી દેવામાં આવે તે કચ્‍છની જનતાનું અપમાન છે. કચ્‍છ પર ધરતીકંપ પછી કુદરતની મહેર રહી છે અને એકપણ દુષ્‍કાળ ધરતીકંપ પછી કચ્‍છમાં પડ્યો નથી. કુદરતની આ કૃપાનો લાભ કચ્‍છના ખેડૂતો અને માલધારીઓને મળવો જોઇએ, તેના બદલે ગુજરાત રાજ્યના મુખ્‍યમંત્રીશ્રીની મીલીભગત ઉદ્યોગપતિઓને જ લાભાન્વિત કરે છે. કચ્‍છના બન્‍ની વિસ્‍તારના પશુપાલકો માટે ઉપયોગી ઘાસ પેદા કરતી એક લાખ એકર જેટલી જમીન ભા.જ.પ.ના રાષ્‍ટ્રીય નેતાના મળતીયાને ગુજરાતના મુખ્‍યમંત્રીશ્રીએ આપી દીધી છે. મુંબઇની ઇન્‍ડીગોલ્‍ડ કંપનીને કરોડો રુપિ‍યાની જમીન સરકારના તમામ અધિકારીઓના અભિપ્રાયથી વિરુધ્‍ધ આપી દેવાનું અપકૃત્‍ય અને ભ્રષ્‍ટાચાર ગુજરાતની આ સરકારે કર્યો છે. ગુજરાત સરકારનો વિકાસ એ રાવણની લંકાના વિકાસ જેવો છે. રાવણની લંકામાં રાવણના માનીતા રાક્ષસોના મહેલ સોનાના હતા, પરંતુ આમ આદમી મુશ્‍કેલીમાં હતો. તે જ રીતે ગુજરાતમાં મુખ્‍યમંત્રીશ્રીના માનીતા ઉદ્યોગપતિઓ માલામાલ છે. તેમના મહેલ સોનાના છે, પરંતુ જબરદાન જેવા સામાન્‍ય મહેનતકશ ખેડૂતોની વ્‍યથા સરકાર સાંભળતી નથી. નર્મદાના પાણી કચ્‍છને સમયસર મળી શક્યા નથી તેની જવાબદારી ગુજરાતની ભા.જ.પ.સરકારની છે.

        ભુજ ખાતેની જાહેરસભામાં કોર કમિટીના સીનીયર સભ્‍યશ્રી કદીરભાઇ પીરઝાદાએ પ્રવચન કરતાં જણાવ્‍યું હતું કે, કચ્‍છના મહેનતકશ લોકોએ ધરતીકંપ પછી કચ્‍છને ફરી ધમધમતું બનાવ્‍યું છે. કચ્‍છના આ વિકાસમાં પહેલો અધિકાર કચ્‍છની જનતાનો હોવો જોઇએ, તેના બદલે બહારથી આવતાં ઉદ્યોગપતિઓને ગુજરાતની ભા.જ.પ.ની સરકાર માલામાલ કરી રહી છે. કચ્‍છમાં જંત્રીના ભાવોની બહુ જ મોટી અસમાનતા ઉભી કરવામાં આવી છે. કેન્‍દ્ર સરકારની નરેગા યોજનાના કરોડો રુપિ‍યા ભા.જ.પ.ના આગેવાનો ખાઇ ગયા છે. જનતા તરફથી જયારે ફરિયાદ દાખલ થઇ છે ત્‍યારે ટપાલ ખાતાના નાના કર્મચારીને પકડીને સરકાર મોટા માથાને  બચાવી રહી છે. હિંમત હોય તો સરકારે  આ સમગ્ર કૌભાંડની તપાસ સી.બી.આઇ.ને સોંપવી જોઇએ.

        કચ્‍છની જાહેરસભામાં ધારાસભ્‍યશ્રી બાબુભાઇ શાહ, જિલ્‍લા કોંગ્રેસ સમિતિના પ્રમુખશ્રી વી. કે. હુંબલ, માજી સંસદસભ્‍યશ્રી ઉષાબેન ઠક્કર તથા જીલ્‍લાના આગેવાનો મોટી સંખ્‍યામાં ઉપસ્થિત રહ્યાં હતાં.

People poured in complaints of hardship and rampant corruption in government administration at a public meeting Congress party had organized in Kutch district. People said that Gujarat government which was vibrant for industrialists was giving cold shoulder to the issues of common men.

Addressing a mammoth rally at Bhuj Gujarat Congress President Arjun Modhwadia said that Chief Minister was freely giving away freebies to Adani group while he had no time for ordinary farmers. He said that land to Adani for Mundra port, land for Archean company were glaring examples of giving precious land to industrialists at a throw away price.

Referring to the claims of Gujarat government that the state has surplus electricity and it is selling it to other states, Modhwadia said that it is the irony of the situation that lakhs of farmers were not given electricity on the pretext of dark zone. However, he said, industrialists are given electricity in dark zone. Leader of Opposition in the State Assembly, Shaktisinh Gohil said that farmer of Kutch Jabbardan Gadhvi had to commit suicide for his land while the government has given 2800 hectare of reserved forest land to Adani on a platter. It is an insult of people of Kutch, he said. The God is very kind to people of Kutch after the 2001 quake as there is no scarcity here after the quake. Government should have helped farmers of Kutch in the changed situation, but chief minister is kind to some industrialists only. Giving other examples, he said that one lakh acre of Banni grassland has been given to Archean Company, a company associated with a senior BJP leader. Gohil described the concept of development of Gujarat government as the concept of development of Rawan in Lanka. Few close to Rawan had privilege of having their houses of gold while most of common people lived life of misery. He said struggling farmers like Jabbardan Gadhvi had to commit suicide sheer out of frustration. Government is not able to provide Narmada waters to people of Kutch timely, he pointed out. Senior Congress leader Kadir Pirzada said that the new Kutch was the creation of industrious people of Kutch and they should enjoy the fruits of their labour. But the government was helping  industrialists mint money, he said. BJP leaders have siphoned money of the NERAGA scheme.

MLA Babubhai Meghji Shah, District Congress President V. K. Humbal and former MP Ushaben Thakkar were among the prominent leaders who attended the meeting which saw thousands turn up with their grievances.

• Despite clear rules, Gujarat government is giving liberty to schools to extort money from parents.
• Right To Education is very clear that a student should be admitted through a transparent system without taking any donation or interview.
• Gujarat government issued a circular on March 7, 2011 that allows schools have their own way.
• Many states in the country have accepted model rules and thus helped millions of students get the best of education facilities.
• Gujarat government has not accepted model rules for the last two years and thus students of Gujarat are deprived of benefits.

 

    Right of Children to Free and Compulsory Education Act, 2009 brought by government of India categorically states that no school can take any donation or capitation fee or interview while giving admission to a student. Despite this clear provision Gujarat government has introduced rules for admission which allow school managements to mint money while giving admission to students. Leader of Opposition in the State Assembly, Shaktisinh Gohil, pointed out that as per GR of the HRD Ministry of Government of India schools will have to give admission through a transparent system of draw after receiving applications from students. The GR issued on November 23, 2010 is very clear that no donation or any kind of interview can be taken.However, the GR issued by Gujarat government on March 7, 2011 says that schools can give admission on first come first get basis or they can go for the draw system. Since the information of date of receipt of application is in the control of the school it can be manipulated for all kind of gains, Gohil pointed out.

     Gohil quoted Rule 13 of the RTE which says that

        No school or person shall, while admitting a child, collect any capitation fee and subject the child or his or her parents or guardian to any screening procedure.

        Screening method is further defined as the method of selection for admission of a child, in preference over another, other than a random method.

     Gohil demanded that the GR of Gujarat government which is violative of the RTE rules should be withdrawn immediately. Gohil said that many states have introduced the law in the last two years. However, Gujarat Chief Minister who claims himself to be number one administrator, has not introduced this student friendly law. This has caused a great loss to the students of Gujarat. Referring to the benefits of RTE, he said that through its student focused measures it can really improve standard of education.

   Listing some of these measures, he said

 

• It gives free education to all till standard 8.
• It makes compulsory for government to provide all basic facilities for education
• A student studying up to standard five gets admission in a school within one kilometer and school up to standard eight has to be within three kms.
• Every school will have a teacher for every 30 students and teachers will not be engaged in any other work except census and election work.
• Special schools for children of poor and child labourers will be closed down and all will get admission to schools with equal opportunity. These special schools have limited facilities.
• Government will have the make special arrangements for the education of children of migrant labourrers.
• The RTE also provides that government will have to make special arrangements for the education of drop outs, rag picker students and students indulging in begging.
• There is a provision of 25 per cent seats for students belonging to educationally backw3ard classes and have nots. They are to be provided equal opportunities of learning without any kind of fee.
• In private schools only draw system is allowed for admission. This is to check corrupt practices in admission.
• To ensure that children study up to standard 8, there is a provision of a steering committee for every school. This committee has to have 75 members representatives of parents of students.

• કેન્‍દ્ર સરકારનો કાયદો અને જી.આર. હોવાછતાં ગુજરાતની સરકારે ખાનગી શૈક્ષણિક સંસ્‍થાઓને ગુજરાતના વિદ્યાર્થીઓને લૂંટવાની છૂટ આપી.
• આર.ટી.ઇ.નો કાયદો સ્‍પષ્‍ટ છે કે, કોઇપણ પ્રકારનું દાન કે ઇન્‍ટરવ્‍યું લીધા સિવાય પારદર્શક ડ્રો દ્વારા વિદ્યાર્થીઓને એડમીશન મળવું જોઇએ.
• ગુજરાત સરકારે તા.૭.૩.ર૦૧૧ના ગેરકાયદેસર પરીપત્ર દ્વારા ખાનગી શૈક્ષણિક સંસ્‍થાઓને એડમીશનમાં મનમાની કરવાની છૂટ આપી.
• આર.ટી.ઇ.ના કાયદાથી વિદ્યાર્થીઓને મળતાં અઢળક લાભો ગુજરાતની સરકાર રોકી રહી છે
• દેશના અનેક રાજ્યોએ કેન્‍દ્ર સરકારના મોડેલ રુલ્‍સ સ્‍વીકારી વિદ્યાર્થીઓને ફાયદો આપ્‍યો છે.
• ગુજરાત સરકાર છેલ્‍લાં બે વર્ષથી આર.ટી.ઇ.ના મોડેલરુલ્‍સ સ્‍વીકારતી નથી અને તેથી ગુજરાતના વિદ્યાર્થીઓ લાભોથી વંચિત.

 

ભારત સરકારે Right of Children to Free and Compulsory Education Act,2009 (આર.ટી.ઇ.એકટ) સમગ્ર દેશ માટે અમલમાં મૂકેલો છે. આ કાયદામાં સ્‍પષ્‍ટ જોગવાઇ છે કે, કોઇપણ ખાનગી શાળા વિદ્યાર્થિને એડમીશન આપતી વખતે ડોનેશન કે કેપીટેશન ફી લઇ શકશે નહી. એડમીશન આપવાની બાબતમાં વિદ્યાર્થિ કે વિદ્યાર્થિના વાલીઓના કોઇપણ પ્રકારના ઇન્‍ટરવ્‍યુ લઇ શકાશે નહી. આ સ્‍પષ્‍ટ જોગવાઇઓ હોવા છતાં ગુજરાતની ભા.જ.પ.ની સરકાર શિક્ષણનું વ્‍યાપારીકરણ કરતી શૈક્ષણિક સંસ્‍થાઓ સાથે મિલીભગત કરીને ગુજરાતના વિદ્યાર્થિઓનું શોષણ કરવા મંજૂરી આપી છે. ભારત સરકારના કાયદામાં સ્‍પષ્‍ટ જોગવાઇ છે કે, શાળામાં દાખલ થવા માંગતાં વિદ્યાર્થિઓની અરજીઓ મેળવ્યા પછી સંપૂર્ણ પારદર્શક રીતે ડ્રોની સિસ્‍ટમ અપનાવી જાહેરમાં લોટરી દ્વારા વિદ્યાર્થિઓને એડમીશન આપવાનું છે. કાયદો બનાવ્યા પછી ભારત સરકારના માનવ સંશાધન વિકાસ મંત્રાલયે ખાસ જી.આર. તા.ર૩.૧૧.ર૦૧૦ના રોજ બહાર પાડીને ગુજરાત સરકારને સ્‍પષ્‍ટ સૂચના આપી છે કે, વિદ્યાર્થિઓને ખાનગી શાળામાં એડમીશન પારદર્શક રીતે ડ્રો કરીને જ આપવાનું રહેશે અને કોઇપણ પ્રકારના ઇન્‍ટરવ્‍યું કે દાન લઇ શકાશે નહી. આ સ્‍પષ્‍ટ કાયદાકીય પરિસ્થિતિઓ હોવા છતાં ગુજરાત સરકારે તા.૭.૩.ર૦૧૧ના પરિપત્ર બહાર પાડીને ખાનગી શાળાઓને એડમીશનમાં મનમાની કરવા દેવા માટે એવી જોગવાઇ કરી છે કે, શાળા પોતાની પાસે આવેલી અરજીઓ પૈકી જે સૌપ્રથમ આવી હોય તે પ્રમાણે નક્કી કરી શકશે. અથવા લોટરી નાંખીને નક્કી કરી શકશે, ગુજરાત સરકારના આ પરિપત્રના કારણે ખાનગી શાળાઓને મનમાની કરવાની છૂટ મળી જાય છે. કઇ અરજી ક્યારે આવી છે તે હકીકત શાળા પાસેજ હોય છે અને માટે પૈસાના વહીવટ અથવા લાગવગ દ્વારા જે વિદ્યાર્થિને એડમીશન આપવું હોય તેની અરજી પહેલાં આવી છે તેવું દર્શાવી  દેવામાં આવે છે. ગુજરાતના વિદ્યાર્થિઓનું શોષણ વ્‍યવસાયીક રીતે ખાનગી શાળા ચલાવતા લોકો કરીશકે તે માટેજ ગુજરાત સરકારે કાયદાની જોગવાઇથી વિરુધ્‍ધ અને કેન્‍દ્ર સરકારના પરિપત્રથી વિરુધ્‍ધ વહેલો તે પહેલાનાં ધોરણો એડમીશન આપવાની છૂટ આપી છે. રાઇટ ટુ એજયુકેશન (આર.ટી.ઇ)ના કાયદાની કલમ-૧૩માં સ્‍પષ્‍ટ જોગવાઇ નીચે મુજબ છે.

સ્‍કીનીંગ પ્રોસીજરની વ્‍યાખ્‍યા આજ કાયદાની કલમ-ર(ઓ) નીચે મુજબ છે.

 “Screening procedure” means the method of selection for admission of a child, in preference over another, other than a random method.

ઉપરની બન્‍ને જોગવાઇઓથી સ્‍પષ્‍ટ થાય છે કે, રેન્‍ડમ પધ્‍ધતિ એટલે કે પારદર્શક પ્રક્રિયા કરીને જાહેરમાં લોટરી (ડ્રો) કર્યા સિવાય એડમીશન આપી જ શકાતું નથી અને ખાનગી શાળાના સંચાલક કોઇપણ પ્રકારના વધારાના રુપિ‍યા કે ઇન્‍ટરવ્‍યું લઇ શકતા નથી. ગુજરાત સરકારની ખાનગી શાળાઓ સાથેની મિલીભગતનો જી.આર. તા.૭.૩.ર૦૧૧નો છે. તેને તાત્‍કાલિક રદ કરવા અને ખાનગી શાળાઓમાં કોઇપણ જાતની મૂડી લીધા વગર ડ્રો થીજ એડમીશન આપવા ગુજરાત વિધાનસભા વિરોધપક્ષના નેતાશ્રી શક્તિસિંહ ગોહિલે માંગણી કરી છે.

        ભારત સરકારે ર૦૦૯માં આર.ટી.ઇ.નો કાયદો દેશના તમામ રાજ્યો માટે આપેલો છે. દિલ્‍હી સહિત દેશના મોટા ભાગના રાજ્યોએ કેન્‍દ્ર સરકારના આ કાયદાનો અમલ શરુ કરી દિધો છે. પોતાના વહીવટને નંબર-૧ કહેવડાવનારા ગુજરાતના  મુખ્‍યમંત્રીશ્રીએ બાળકો માટેના અતિ ઉત્‍તમ કાયદાના મોડેલરુલ્‍સ બે વર્ષથી સ્‍વીકાર્યા નથીઅને તેના કારણે ગુજરાતના વિદ્યાર્થિઓને અતિશય નુકશાન થઇ રહ્યું છે. આર.ટી.ઇ.ના કાયદાના અમલથી વિદ્યાર્થિઓને અનેક ન કલ્‍પી શકાય તેવા લાભો પ્રાપ્‍ત થાય છે. કાયદાથી સાચા અર્થમાં શિક્ષણનું સ્‍તર સુધારી શકે તેમ છે અને શિક્ષણ ક્ષેત્રે ચમત્‍કારો થઇ શકે તેમ છે. આર.ટી.ઇ.ના કાયદાના અમલથી નીચે મુજબના અતિ મહત્‍વના ફાયદાઓ વિદ્યાર્થિઓને મળી શકે છે.

 

• દરેક બાળકને કોઇપણ પ્રકારના ભેદભાવ વગર આઠ ધોરણ સુધી મફત શિક્ષણનો અધિકાર મળે છે.
• દરેક બાળકને ઉત્‍તમ ભણતર માટે જરુરી તમામ સગવડો કરવાની જવાબદારી હવેથી સરકારને માટે ફરજીયાત બને છે.
• પાંચમા ધોરણ સુધીની નિશાળ એક કિલોમીટરની અંદર હશે. આઠ ધોરણ સુધીની નિશાળ ત્રણ કિલોમીટરની અંદર હશે.
• દરેક નિશાળમાં ત્રીસ વિદ્યાર્થિએ એક શિક્ષક હશે. શિક્ષકો પાસે શિક્ષણ સિવાયના કામ(ખાસ સંજોગોમાં વસ્‍તી ગણતરી કે ચૂંટણીને બાદ કરતાં) હવેથી સરકાર કરાવશે નહી.
• ગરીબ બાળકો માટે ગરીબ નિશાળ જેવી સર્વ શિક્ષા અભિયાનની વૈકલ્પિ‍ક શાળાઓ (બીન તાલીમી શિક્ષકો,૧૦૦૦ રુપિ‍યા જેવા ઓછા પગારવાળા શિક્ષકો, અડધા સમયની નિશાળો), બાળમજૂરી કરતાં બાળકોની એન.સી.એલ.પી. નિશાળો હવે. પછી બંધ થશે. આવી શાળાઓના બાળકો માટે તેમની જરુરિયાતોને ધ્‍યાનમાં રાખીને ખાસ સમાન તકની શિક્ષણ વ્‍યવસ્‍થાઓ સરકાર પૂરી પાડશે.
• રોજીરોટીની શોધમાં મજૂરી માટે સ્‍થળાંતર કરતાં કુટુંબોના બાળકો માટે તેમની મુશ્‍કેલીઓને ધ્‍યાનમાં રાખી ખાસ જરુરી વ્‍યવસ્‍થાઓ સરકાર કરશે. જેથી આ બાળકો તેમના માતા પિતા જેવા અભણરહે નહીં.
• નિશાળે ન જતા હોય, રખડતા ભટકતાં હોય, કાગળ કચરો વીણતાં હોય, બુટપોલીશ કરતાં હોય, ભીખ માંગતા હોય તેવા બાળકોની પરિસ્થિતિ અને લાક્ષણિકતાઓને ધ્‍યાનમાં લઇને આવા બાળકોને બાળપણ મળે, શિક્ષણની સુવિધા મળે તે માટે યોગ્‍ય ઉકેલ વિચારીને ખાસ વ્‍યવસ્‍થાઓ કરવાની જવાબદારી સરકારની બને છે.
• ખાનગી શાળાઓમાં રપ ટકા પ્રવેશ આર્થિક રીતે નબળાં તેમજ વંચિત  સમાજના બાળકો માટે અનામત રહેશે. તેમની પાસેથી કોઇપણ પ્રકારની ફી લીધા સિવાય સમાન તકની શિક્ષણ વ્‍યવસ્‍થા આપવાની  જવાબદારી ખાનગી શાળાના સંચાલકોની રહેશે.
• ખાનગી શાળાઓમાં કોઇપણ પ્રકારનું ડોનેશન લેવા ઉપર પ્રતિબંધ લાગુ પડે છે. પ્રવેશ આપવામાં થતાં ભ્રષ્‍ટાચારને રોકવા પ્રવેશ ઇન્‍ટરવ્‍યુ લઇ શકાશે નહીં. પ્રવેશ સંખ્‍યા કરતાં વધુ અરજીઓ આવે ત્‍યારે ફકત લોટરી ડ્રો કરીને પ્રવેશ આપવો ફરજીયાત છે.
• દરેક બાળક નિશાળમાં દાખલ થાય, નિશાળમાં સતત હાજર રહીને ભણતું રહે અને આઠમા ધોરણ સુધી સારું શિક્ષણ મેળવી શકે તે માટેની કાળજી સરકારે રાખવી ફરજીયાત છે. સરકારને આ જવાબદરી નિભાવવામા; મદદ કરવા માટે દરેકશાળામાં શાળા સંચાલન સમિતિ બનાવાશે. જેમાં ૭પ ટકા પ્રતિનિધિત્‍વ જે તે શાળામાં ભણતાં બાળકોના માતા પિતાનું હશે. આ સમિતિ ઉત્‍તમ નિશાળ માટે જરુરી તમામ કામોનું આયોજન, દેખરેખ અને નિયંત્રણ કરશે. આ સમિતિની જે જવાબદારી છે તે નિભાવવા માટે તેમને જરુરી સત્‍તા પણ આપવામાં આવેલ છે.

          Here is a copy of the reaction Information Department released in your name in response to my press conference on Kutch land issue. I have raised the issue as a responsible opposition on the basis of the information I had obtained under the RTI. You have claimed that it was a legal deal but you have not mentioned the provisions of the law while justifying the deal as legal.

          I request you to discuss the issue in the premises of Gandhi Ashram on just these four points. If I prove wrong, I will tender open apology to you, your government and public on the issue.

          If you are not able to establish the legality of the deal you will have to compensate the loss the deal has caused to the exchequer.

We will discuss on public platform following issues.

1.  Why government did not take possession of the land in the jurisdiction of Kukma and Moti reldi under provisions of section 89 of Bombay Tenancy and Agricultural Lands Act ?

2.  Why did all officers remarked on the file that there is no provision to sell the land directly to the industrialist while suggesting
that Government should take possession of the land. The officers included the then Chief Secretary D. Rajgopalan, Principal Secretary G. Aloria, P. Paneervel and Deputy Secretary Manoj Oza ?

3.  If permission could be given for the deal then why the Revenue Minister wrote that let us give permission for the sale as an exceptional case?

4.  Under what provisions of the law, the Revenue Minister gave permission for the sale ?

          I request you two spokeministers and the Revenue Minister to have open debate with me on the issue today, Tuesday at Gandhi Ashram at 4 pm. I will be alone. If you can convince me about the legality of the issue, I will tender public apology to you all and public. If you agree to this request please convey to me by 2 pm and be at Gandhi Ashram at 4 pm.        આપ બન્‍ને માનનીય પ્રવક્તા મંત્રીશ્રીઓના નામથી ગુજરાત માહિતી બ્યુરો ગુજરાત સરકાર દ્વારા ગઇકાલ તા.રપ.૪.ર૦૧૧ને સોમવારના રોજ મેં કચ્‍છની જમીનના મુદ્દા અંગે યોજેલી પ્રેસ કોન્‍ફરન્‍સનું રીએકશન એક સભ્ય સમાજમાં ન શોભે તેવી ભાષામાં પ્રસિધ્‍ધ થયાની નકલ આ સાથે રજૂ  કરુ છું. મેં આર.ટી.આઇ. દ્વારા ફાઇલ ઉપરની નોંધો સાથેની જે. માહિતી આપનીસરકારે મને આપેલી હતી તેના આધારીત વિવેકપૂર્ણ રીતે એક જવાબદાર વિરોધપક્ષની ભૂમિકામાં પ્રેસ અને મીડીયાને હકીકત આપી હતી. આપશ્રીના રીએકશનમાં આપે આ જમીન ખાનગી માલિકને આપી દેવાની કાર્યવાહીને નિયમાનુસરની ગણાવવા પ્રયત્‍ન કરેલો છે પરંતુ કયા કાયદાના કયા નિયમો નીચે તે આપે લખેલું જ નથી. મારી આપશ્રીને વિનંતી છે કે, આ મુદ્દા ઉપર અમદાવાદ ખાતેના ગાંધી આશ્રમની પવિત્ર ભૂમિ ખાતે જાહેર મંચ પર આપણે માત્ર મારા નીચે જણાવેલા ત્રણ મુદ્દાની ચર્ચા કરીએ અને જો તેમાં હું ખોટો ઠરીશ તો હું જાહેરમાં આપશ્રીની તેમજ સરકાર અને  પ્રજાની જાહેર મંચ પરથી જ માફી માંગીશ.

         જો આપશ્રી કાયદાની જોગવાઇ મુજબ સરકાર હસ્‍તગત લેવાની જમીન ખાનગી ઉદ્યોગપતિને બિન કાયદેસરરીતે નથી આપી તેવું સાબિત ન કરી શકો તો  પ્રજાની તિજોરીમાં જે કરોડોનું નુકશાન થયું છે તે આપશ્રીએ ભરવું પડશે.

         નીચેના મુદ્દાઓની જાહેર મંચ પર આપણે ચર્ચા કરીશું.

૧.     મુંબઇ ગણોત વહીવટ અને ખેતીની જમીનોના કાયદાની કલમ-૮૯(ક)(૪) (ક), (ખ) અને (પ)ની જોગવાઇ મુજબ કચ્‍છની કુકમા અને મોટીરેલડીની જમીન રાજ્યસાત એટલે કે સરકાર હસ્‍તક શા માટે લેવામાં ન આવી?

 ર.     સરકારના ઉપ સચિવશ્રીથી માંડીને નાયબ સચિવશ્રી મનોજ ઓઝા, અગ્રસચિવશ્રી (જમીન સુધારણા) જી.એ.અલોરીયા તથા અગ્ર સ‍ચિવશ્રી પી.પનીરવેલ, (મહેસુલ વિભાગ), તથા જે તે વખતના મુખ્‍યસચિવશ્રી ડી.રાજગોપાલને ફાઇલ પરની સ્‍પષ્‍ટ નોંધમાં શા માટે એમ લખ્‍યું છે કે ઉદ્યોગપતિને આ જમીન વેચવાની કાયદામાં કોઇ જોગવાઇ જ નથી અને  જમીન રાજ્ય હસ્‍તક જ સરકારે લઇ લેવાની થાય છે.

 ૩.    જો કાયદા  અને નિયમથી ખાનગી વ્‍યકિતને જમીન વેચવાની પરવાનગી મળવાની થતી હતી તો  પછી માન. મહેસુલમંત્રીશ્રીએ શા માટે એમ લખ્‍યું છે કે, !! ખાસ કિસ્‍સા તરીકે વેચવાની પરવાનગી આપીએ!!.

૪.     પ્રવર્તમાન કયા કાયદાની કઇ કલમની જોગવાઇઓ નીચે માન. મહેસુલમંત્રીશ્રીએ કરોડો રુપિ‍યાની ‍િ‍કંમતની જમીન ખાનગી ઉદ્યોગપતિને આપી ?

         જાહેર મંચ પર એક તરફ આપ બન્‍ને પ્રવક્તા મંત્રીશ્રીઓ તથા નિર્ણય કરનારા મહેસુલમંત્રીશ્રીએ ઉપસ્થિત રહે અને સામા પક્ષે માત્ર હું એકલો ઉપસ્થિત રહીશ. જો જાહેર મંચ પર મેં ઉઠાવેલા ઉપરોકત મુદ્દાનો આપ કાયદેસરનો વ્‍યાજબી ખુલાસો કરી મને હું જો જુઠ્ઠો છું તેમ સાબિત કરી શકશો અને જો આપ મહાનુભવો મને સત્‍ય સમજાવી શકશો તો હું આપની જાહેરમાં માફી માંગીશ. આપશ્રીને આ પત્ર રુબરુ હાથોહાથ પહોંચાડી રહ્યો છું અને આજરોજ તા.ર૬.૪.ર૦૧૧ને મંગળવાર રોજ સાંજે ૪-૦૦ કલાકે અમદાવાદ ખાતે ગાંધી આશ્રમની પવિત્ર ભૂમિ પર ચર્ચા કરવા આપને આહવાન આપુ છું. જો આપશ્રી આજે મારા આહવાનને સ્‍વીકારતા હો તો મને બપોરના ર-૦૦ કલાક સુધીમાં મારા મોબાઇલ નં.૯૮ર૪૦ ૦૦૮પર અથવા મારા કાર્યાલયના ટેલિફોન નં.ર૩રર૦૯૯પ ઉપર જાણ કરશો.

અખબારીયાદી                                           તા.રપ-૪-ર૦૧૧

• તમામ કાયદાથી વિરુધ્‍ધ જઇને કરોડો રુપિ‍યાની બે લાખ ચોરસવાર જમીન મહેસુલમંત્રીશ્રીએ ભ્રષ્‍ટાચારથી મે.ઇન્‍ડીગોલ્‍ડ રીફાઇનરી લી.મુંબઇને આપી.
• તમામ અધિકારીશ્રીઓએ ફાઇલ પર સ્‍પષ્‍ટ નોંધ લખી હતી કે, કરોડો રુપિ‍યાની કચ્‍છની જમીન રાજ્ય સરકાર હસ્‍તક જ લઇ લેવી પડે.
• કાયદામાં કોઇપણ અધિકાર કે જોગવાઇ ન હોવાછતાં રાજ્ય સરકાર હસ્‍તક લેવાની જમીન મહેસુલ મંત્રીશ્રીએ મુખ્‍યમંત્રીશ્રીના મેળાપીપણામાં ઉદ્યોગપતિને આપી.
• વિરોધપક્ષના નેતાએ આર.ટી.આઇ.માં મેળવેલી ફાઇલ પરની નોંધની સીલસીલાબધ્‍ધ હકીકતો રજૂ કરી.
• ભ્રષ્‍ટાચાર સામેની લડતની વાતો કરનાર ભાજપના મોવડી મંડળમાં હિંમત હોય તો કરોડોના જમીન કૌભાંડની તપાસ હાઇકોર્ટ કે સુપ્રિમ કોર્ટના ન્‍યાયધીશને સોંપે.

તમામ કાયદાઓ અને નિયમોથી વિરુધ્‍ધ જઇને કરોડો રુપિ‍યા જેવી કિંમતની અતિ મહત્‍વની જમીન મુખ્‍યમંત્રીશ્રી અને મહેસુલ મંત્રીશ્રીએ ભ્રષ્‍ટાચારથી ઇન્‍ડીગોલ્‍ડ રીફાઇનરીને આપી દિધી છે. વિરોધપક્ષના નેતાશ્રી શક્તિસિંહ ગોહિલે પ્રેસ અને મીડીયાને આર.ટી.આઇ.ના કાયદા નીચે ફાઇલ પરની મેળવેલી નોંધની નકલો આપીને જણાવ્‍યું હતું કે, ફાઇલ પર કચ્‍છના કલેકટર અને સચિવાલયના સેકશન અધિકારીશ્રીથી માંડીને ચીફ સેક્રેટરી સુધી સર્વે અધિકારીશ્રીઓએ સ્‍પષ્‍ટપણે લખ્‍યું હતું કે, ઇન્‍ડીગોલ્‍ડ રીફાઇનરીને કચ્‍છના કુકમા અને મોટી રેલડી ખાતેની બે લાખ ચોરસવાર (એકર ૩૯.રપ ગુંઠા) જમીન વેચાણથી એલ્‍યુમીના રીફાઇનરી લિ. મુંબઇને વેચવાની પરવાનગી આપી શકાય નહીં. કાયદાઓની જોગવાઇ મુજબ આ જમીન રાજ્યસાત થાય એટલે કે રાજ્ય સરકારે આ જમીન પોતાને હસ્‍તગત લઇ લેવાની થાય છે. આ અધિકારીશ્રીઓએ નોંધમાં એવું પણ લખ્‍યું કે, પ્રવર્તમાન કાયદાની જોગવાઇ આ જમીન ઇન્‍ડીગોલ્‍ડ રીફાઇનરી કંપનીએ વેચવાની જે મંજૂરી માંગી છે તે મંજૂરી આપવાની કોઇપણ જોગવાઇ નથી. આમ કાયદાની સંપૂર્ણ જોગવાઇઓની વિસ્‍તારથી નોંધ તમામ અધિકારીશ્રીઓએ લખીને કરોડો રુપિ‍યાની આ જમીન સરકાર હસ્‍તગત લેવા તા.૮.૭.ર૦૦૯થી ઓક્ટોબર-ર૦૦૯ સુધીની નોંધ લખેલી હતી. ત્‍યારબાદ મહેસુલ મંત્રીશ્રીએ પોતાને કોઇપણ જાતના કાયદાકીય અધિકાર નહીં હોવા છતાં કરોડો રુપિ‍યાની આ જમીન ખાસ કિસ્‍સા તરીકે ઇન્‍ડીગોલ્‍ડ રીફાઇનરીને વેચવા માટે આપી દેવા હુકમ કર્યો  હતો. મહેસુલમંત્રીશ્રીના આ હુકમ પછી અગ્રસચિવ(જમીન સુધારણા)એ એવી નોંધ લખી હતી કે, આ જમીન મંત્રીશ્રીએ કહ્યા મુજબ નિકાલ કરવાની કોઇ નીતિ કે જોગવાઇ જ નથી આમ છતાં જો આ જમીન ઉદ્યોગપતિને વેચવાની મંજૂરી આપવી હોય તો સરકારે આ જમીનના !! unearned income !!તરીકે પ૦ ટકા રકમ સરકારની તિજોરીમાં લેવી જોઇએ અને આ માટેની નીતિ નક્કી કરવી જોઇએ. જેના ઉપર અગ્રસચિવશ્રીએ સ્‍પષ્‍ટ નોંધ લખી કે, વ્‍યાજબી તો એ ગણાય કે કાયદાની જોગવાઇ મુજબ આ જમીન સરકારેજ લઇ લેવાની થાય અને તે પછી પ્રવર્તમાન બજાર કિંમત લઇને નવી પાર્ટીને સરકારે આપવી જોઇએ. આ પ્રકારની નોંધ તમામ અધિકારીશ્રીઓએ કર્યા પછી પણ તા.૪.૧૧.ર૦૦૯ના રોજ મહેસુલમંત્રીશ્રીએ આદેશ કર્યો કે, !! ખાસ કિસ્‍સા તરીકે અગાઉ સૂચવ્‍યા મુજબ વેચાણની પરવાનગી આપીએ !!

કાયદાની જોગવાઇ ગણોત ધારાની કલમ-૬૩ મુજબ એ પ્રકારની છે કે જો કોઇ ઓદ્યોગિક એકમ ઉદ્યોગ માટે ખેતીની જમીન ખરીદ કરે તો તેણે ચોક્કસ શરતોને આધીન ઔદ્યોગિક એકમમાં બાંધકામ કરી ઉદ્યોગ શરુ કરવો જોઇએ જો ઔદ્યોગિક એકમ નિર્ધારીત સમય અને શરતો મુજબ ઉદ્યોગ શરુ ન કરે તો જમીન રાજ્યસાત કરી અને સરકાર હસ્‍તક લેવાની થાય. કાયદાની કલમ-૬૩(એ)(એ) સ્‍પષ્‍ટ છે કે, કલેકટર ઉદ્યોગગૃહને જમીન ખરીદવાનું પ્રમાણપત્ર આપે તે  છ મહિના માટેનું હોય અને ત્‍યારબાદ જો ઉદ્યોગગૃહ મુદત લંબાવવાની અરજી કરે તો તેની વ્‍યાજબીતા તપાસ્‍યા પછી વધારેમાં વધારે ત્રણ વર્ષ સુધી કલેકટરશ્રી મુદત વધારો આપી શકે. જો ખરીદનાર ઉદ્યોગ શરુ  કરવામાં નિષ્‍ફળ જાય અને મુદતવિતી જાય તો જમીન રાજય સરકારમાં નીહિત થાય અને રાજ્ય સરકાર તે જમીનનો કબજો મેળવે છે. આ ચોક્કસ કિસ્‍સામાં ઇન્‍ડીગોલ્‍ડ રીફાઇનરી દ્વારા વર્ષ-ર૦૦૩માં ખેતીની જમીન ખરીદવા પ્રમાણપત્ર લેવામાં આવેલું હતું. ગણોત વહીવટ અને ખેતીની જમીનો (વિદર્ભ અને કચ્‍છ) અધિનિયમ કલમ-૮૯(ક)માં કરેલી જોગવાઇ મુજબ પ્રમાણપત્ર મેળવ્‍યાની તારીખથી ત્રણ વર્ષમાં ઔદ્યોગિક પ્રવૃત્તિ શરુ કરવી જોઇએ.આ ચોકકસ કિસ્‍સામાં જમીન ખરીદયા પછી ઇન્‍ડીગોલ્‍ડ રીફાઇનરી લિ.મુંબઇ દ્વારા કોઇજ ઔદ્યોગિક પ્રવૃત્તિ કરવામાં આવેલ નથી કે છ મહીના પછી મુદત વધારવા માંગણી પણ કરવામાં આવેલી ન હતી. સન-ર૦૦૩માં ખરીદેલી જમીનના ત્રણ વર્ષ દરમ્‍યાન ઉત્‍પાદન પણ શરુ થયું નથી. કે મુદત વધારવાના વધુમાં વધુનો સમય પણ પૂર્ણ થઇ ગયેલો છે. ત્‍યારબાદ ઇન્‍ડીગોલ્‍ડ રીફાઇનરી વાયબ્રન્‍ટ ગુજરાતના નામ પર એલ્‍યુમીના રીફાઇનરી પાસે  મુખ્‍યમંત્રી સમક્ષ તા.૧૮.૬.ર૦૦૯ના રોજ રજૂઆત કરે છે કે, પોતાને ઉદ્યોગ કરવા માટે ઇન્‍ડીગોલ્‍ડ રીફાઇનરી મુંબઇ જમીન વેચે તેને સરકારે મંજૂરી આપવી. મુખ્‍યમંત્રીશ્રીને કે તેમના કાર્યાલયને કોઇજ અધિકાર ન હોવા છતાં તા.ર.૭.ર૦૦૯ના રોજ મુખ્‍યમંત્રીશ્રીના સચિવે  એલ્‍યુમીના રીફાઇનરીની રજૂઆત મહેસુલ વિભાગને મોકલી હતી. ત્‍યારબાદ તમામ અધિકારીશ્રીઓએ કાયદાની જોગવાઇઓની વિસ્‍તૃત નોંધ લખ્‍યા પછી સ્‍પષ્‍ટ રીતે કરોડોની આ જમીન સરકાર હસ્‍તક જ આવવી જોઇએ તેના બદલે મહેસુલમંત્રીશ્રીએ ભ્રષ્‍ટાચારથી કોઇપણ કાયદાથી તેઓને અધિકાર નથી તેવો હુકમ જમીન વેચવાની મંજૂરીનો આપેલો છે તે વાયબ્રન્‍ટ ગુજરાતમાં મુખ્‍યમંત્રીશ્રી અને ભાજપની સરકાર જે ભ્રષ્‍ટાચાર કરે છે તેનો સૌથી મોટો પુરાવો છે.

વિરોધપક્ષના નેતાએ સ્‍પષ્‍ટ માંગણી કરી છે કે, કરોડો રુપિ‍યાનું ગુજરાતની તિજોરીને નુકશાન કરનાર મહેસુલમંત્રીશ્રીની સામે તપાસના આદેશ થવા જોઇએ. ગુજરાત રાજ્યના મુખ્‍યમંત્રીશ્રી કરોડોથી ઓછું કાંઇ ખાતા નથી તેનો સૌથી મોટો પુરાવો  આજે ફાઇલ પરની ઓરીજીનલ નોંધોની નકલ સાથે વિરોધપક્ષના નેતાએ પ્રેસ અને મીડીયા સમક્ષ રજૂ કર્યો હતો.. ભ્રષ્‍ટાચાર સામે બણગાં ફૂંકનારા ભાજપના કેન્‍દ્રીય મોવડી મંડળમાં હિંમત હોય તો ગુજરાત સરકારના આ ભ્રષ્‍ટાચાર સામે પગલાં ભરે અથવા નામદાર હાઇકોર્ટ કે સુપ્રિમ કોર્ટના સીટીંગ જજ કે સી.બી.આઇ.ને  તપાસ માટેના આદેશ કરે.

• Going against all rules of law, Revenue Minister gave two lakh square meter of land to a Mumbai based company Indigold Refinery.
• This is despite the legal opinion of all officers that the government should take possession of the land.
• There is no provision in law authorizing the Revenue Minister to allow such land to be sold directly to a businessman.
• Leader of Opposition released details of multi billion rupee scandal with the facts he obtained through RTI.
• Government should appoint a high level inquiry into the scandal if it is really committed to fight corruption as it claims.

Leader of Opposition Shaktisinh Gohil today brought out a multi billion rupee land scandal of Modi government. In this Revenue Minister, a close confidant of Chief Minister, allowed a businessman to sell two lakh square of precious land in Kutch instead of government taking possession of the land.

Giving the details of a case of utter violation of law and total disregard to the objections of all concerned officers of the Revenue Department, Gohil challenged the government to set up inquiry by a High Court or Supreme Court judge into the land scam. He said that under the law the government should have taken possession of the land of businessman. But, Modi government showed soft corner for the businessman and allowed him to sell two lakh square meter of land to another businessman.

In this case, he said, Mumbai based Indigold Refinery, was given two lakh square meter of land in Kutch. It was agricultural land and under law the businessman had to start production from the proposed unit within a stipulated period failing which the government had to take possession of the land. In this case, the Indigold Refinery did not start the project and decided to sell the land to Allumina Refinery. And taking side of Indigold, Revenue Minister threw all rules to winds and allowed it to sell the land to Allumina Refinery.

Gohil released to the newsmen the papers of the illegal deal in which all government officers had objected to the deal but Revenue Minister okayed it overruling objections. This is about the land in the jurisdiction of Kukma and Moti Reldi village. This agricultural land was given to Indigold. This company did not start the project within the time limit of thee years as per law. In such a case the government should have taken possession of land.

However, Indigold came out with a proposal to sell the land to Allumina Refinery. All officers right upto Principal Secretary Revenue opposed it. This is clear from the noting on the proposal file from July 2009 to October 2009. Overruling this, the Revenue Minister said that the company should be allowed the deal as a special case.

In the meantime an officer suggested that there should be amendment in policy and the government should collect 50 percent of the unearned income. However, this was also rejected by the principal secretary who said that as per law the government should take possession of land and then it can sell it to the other party at market price. Even this was overruled by the Revenue Minister who, on November 4, 2009, further remarked that as per earlier instructions the company should be allowed to sell the land directly as an exceptional case.

Indigold had bought land in 2003 and as per the law it had to start production within three years by any means. The company did not start production. What is more interesting is the fact that the company which was given land initially with six month certificate even did not applied for extension. The government should have taken possession by 2004, Gohil pointed out.

After six years, Indigold came out with a request to sell the government land which the Revenue Minister happily allowed despite objections by all concerned officers. Gohil described it as a glaring example of corruption by Modi government and said that Government should appoint a high level inquiry into the scandal if it is really committed to fight corruption as it claims.
