  • Authentic document of discussion in the State Assembly brings out the truth of Lokayukta issue.

Leader of Opposition in the Assembly Shaktisinh Gohil today exposed the lies of Modi government about thwe power of appointment of Lokayukta. He released to media details of discussion in the House which established the fact that Governor alone has power to appoint Lokayukta.

Gohil quoted from the speech of the FinanceMinister Vajubhai Vala which he had made on behalf of the Chief Minister that Governor has righttoappoint Lokayukta. Vala had said “Governor shall appoint shows that Governor has power to appoint Lokayukta but he has to consult High Courtjudge before that” “This right is of Governor alone Vala said”.

This was stated by Vala during discussion on the demands of GAD on 14.3.2011. ChiefMinister holds the charge of GAD and on his behalf the number two in his cabinet Vala had replied to the discussion on the demands of GAD. Gohil gave copy of discussion of March 14 to the media to prove his point. This makes it amply clear that on behalf of Chief Minister Vala accepted that only Governor has right to appoint Lokayukta and he has to consult Chief Justice before it.

Vala also made it clear that since the powertoappoint Lokayukta exclusively rests with the Governor, the matter of appointment of Lokayukta cannot be discussed in the House. House can discuss at length an issue of power of government or power of the Governor on the basis of consultation with the government, Vala had further asserted.

The document with these details on Page 49 clearly establishes that government had misled High Court when it claimed that Governor does not have right but he has toact on advice of the Government. Government had made this submission in the Court yesterday.

It is a well establishedfact that a statement made by a minister in the House is taken as stand of the government on that issue. All statements are part of collective responsibility of Government. In case of any discrepancyin two statements on an issue, the statement made in the House is considered as authentic and right statement on the issue, Gohil said.

Lie of BJP on the issue is exposed by the statement of its own minister. The difference between Lokayukta Act here and in other states is clear from the proceeding during the formation of the Act and the statement of Vala, he said.

The truth of the lies Modi and his government are spreading from streets toPresidentHouse and courts to Parliament is clear from the mostauthentic documents on the issue.
