  • MLAs and MPs of Congress party submitted a memorandum to the Governor.

  • BJP has completely failed in administration and so to avoid people’s ire it is trying to whip communal passions.
  • CBI is inquiring into fake encounter as per the orders of the Supreme Court. To create obstacles in it, the BJP is trying to create communal rift in Gujarat.  
  • BJP had no problem when Gujarat police arrested 19 police officers, but it is crying hoarse when CBI arrested one officer.
  • BJP wants to strengthen its vote bank even if it is done by dividing people of Gujarat.
  • BJP leaders’ press conference, leaflets, graffiti and hoardings are solely for causing communal riots.
  • BJP is actively engineering riots since people have been maintaining cool realizing its ulterior motives.
  • Under SC order action is being taken against corrupt, biased and such police officers who killed innocent. This has boosted the morale of honest and upright police officers.
  • BJP inspired 2002 riots caused great damage to Gujarat and its people. Many repent it in jails even today that it was a result of bad motives of BJP.
  • Though it invites the provisions of the Indian Penal Code, no action has been taken against those who indulged in holding press conference, creating hoards and writings that provoked communal riots.

  • Congress has demanded that the Governor takes action and apprise the President about the situation.
  • Despite people’s naming the culprit, police is not taking any action against them under pressure of government.
  • Inquiry under instructions of the Supreme Court is going to catch culprits. BJP is trying to create obstacle in the work of CBI by causing communal riots.

The Memorandum submitted to H.E. The Governor of Gujarat

H.E. The Governor,

We, MLAs, MPS and leaders of Congress party wish to draw your attention as the constitutional head of the state and request you to use your constitutional powers and take appropriate action in the interest of
the State.

Gujarat government has completely failed in fulfilling the promises it had given to people. Elections of local self governments are due in coming months. There is acute shortage of water. Fodder is not available. Despite drought conditions, government has not declared drought. No cash doles, no cattle camps and no relief have been started by the state government. MOUs of crores of rupees have been announced, but no investment has come. The number of unemployed has been steeply increasing. Farmers are not getting adequate power supply.

Unnecessary expenditures for publicity and nourishing whims have increased. To meet these expenses, the burden of VAT and surcharge on VAT has been imposed on people of Gujarat. As a result, the ruling party will be wiped out in the coming local self government elections. Realizing this ruling party is trying to distract the attention of people from these basic issues and whip up communal passions for vote bank politics.

The entire country knows that the UPA government or Congress party has no role in the CBI inquiry being conducted in Gujarat. Under the orders of the Supreme Court, the CBI is investigating fake encounter case. There were many cases like Tulsiram Prajapati, Gopinath Pillai and Kausarbi. Despite this being clear, BJP leaders held a press conference and indulged in all kind of loose talk which was totally distorted and highly provocative to flare up communal violence and cause animosity between people.

This press conference was followed by circulation of posters which divide people in the name of religion. Senseless messages that the CBI investigation was an insult of people of Gujarat or it demoralized police force the press conference and posters dominated.

However, the Gujarat government has accepted the fact of fake encounter and arrested 19 policemen to prevent CBI inquiry. It is difficult to swallow that arrest of 19 by Gujarat police does not demoralize the police force, but arrest of one by the CBI does.

In reality this is being talked about because Supreme Court has not accepted the contention of Gujarat government that police officers were responsible for the fake encounter and they used to kill people for name and fame. The Court has asked the CBI to find out whether these encounters were part of larger conspiracy. As a result, behind the curtain leaders are now desperate and are tempted to damage the state by causing trouble in the name of religion. Gujarat has place of pride in the world because of his message of non violence.

Even in 2002 this Gujarat government had played vote bank politics and caused Hindu Muslim riots. This caused on blot on Gujarat. Even today many Hindus and Muslims are in jail. And many Hindus and Muslims had suffered unimaginable damage. In administration, BJP has failed. To avoid the ire of people, it is trying to flare up communal passion. BJP does not want suffer any loss even at the cost of the peace of the state. It is trying to strengthen its vote bank. 

After recent press releases and pamphlets there were huge highly provocative advertisements in main Gujarati newspapers of several lakhs of rupees with a motive to incite communal violence and spreading hatred between people of Gujarat. These advertisements had content that amounted to treason as well as contempt of Supreme Court. After this huge posters were put up all over the state with an intention to create communal disturbances. Despite these efforts of the ruling party the people of the state maintained peace. As the evil designs of the ruling party did not work, it created conspiracies to turn even small incidents like collision of two scooters into communal incidents. Not only that the ruling party even managed stone pelting in areas where Hindus and Muslims are neighbours and live peacefully. The police officers are also working at the instance of government and encouraging communal riots. There is no reason for communal riots in Ahmedabad but it is only due to state government’s conspiracies. No action has been taken against people whose names have been given to police. This is at the behest of the state government. As part of a conspiracy in Ahmedabad, petty criminals are beings used for attacks by knives and sharp weapons. It appears that there is only one person behind these acts because the pattern of injury is the same. 

Even in past their Prime Minister had criticized them for such attitude.. Unfortunately the government at the Centre that time was weak and partial and therefore could not prevent Gujarat government from instigating riots in the state. By this the ruling BJP no doubt strengthened its vote bank but at the cost of people who suffered huge losses. The BJP is conspiring to create communal violence in the state again as elections to local self governments are approaching and to divert attention from the inquiry being conducted as per the order of Honourable Supreme Court. We request you to take strict action in this regards.

After action against corrupt police officers who killed innocent people for publicity and good postings and medals the morale and confidence of upright officers has increased. The honest and upright officers are satisfied with the justice being delivered by the Honorable Supreme Court. As confidence of such police officers will increase the people of the state will also feel safe.

As per the Indian Penal Code it is an offence to put up hoardings, writings on wall or release advertisements inciting communal violence but it has not come to our notice that state government has taken any action or initiated inquiry against any one. It is the responsibility of the district magistrate to remove any hoardings or writings on the wall which can create communal disturbances. But since the state government itself wants to create disturbances such hoardings have not been removed. In such a situation as the Constitutional head of the state we urge you to take action
against the responsible and to inform the Honurable President of the country about it.

The riots in Ahmedabad have been inspired by the state government. We request you to conduct a detailed inquiry into the incident and give instructions to maintain law and order in the city.
